AN ORDINANCE WAIVING THE REQUIREMENTS OF
FORMAL COMPETITIVE BIDDING FOR THE PURCHASE
OF A NEW 75' AERIAL LADDER FIRE APPARATUS FROM
LEECO, INC. AND DECLARING AN EMERGENCY.
WHEREAS, an Aerial Ladder Fire Apparatus is essential to provide fire and rescue
services to the citizens of Fayetteville, and;
WHEREAS, the current Aerial Ladder Fire Apparatus has experienced a total engine
failure and is unusable, and;
WHEREAS, this essential unit can be more quickly replaced than repaired, and;
WHEREAS, the City Council finds that such circumstances constitute an exceptional
situation where competitive bidding is not feasible or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas, hereby waives
the requirements of formal competitive bidding for the purchase of a new 75' Aerial
Ladder Fire Apparatus from Leeco, Inc.
Section 2. Emergency Clause. That the City Council of the City of Fayetteville,
Arkansas, having found that the replacement of the Aerial Ladder Fire Apparatus is
essential to provide fire and rescue services to the citizens of Fayetteville, without undue
delay, hereby declares this ordinance to be necessary to preserve the public peace, health,
and safety, and because of such, an emergency is hereby declared to exist and this
ordinarlqe shall be in full force and effect from the date of its passage and approval.
