AN ORDINANCE TO AMEND §34.23 OF THE FAYETTEVILLE CODE
TO CHANGE THE AMOUNT ABOVE WHICH QUOTATION BIDS ARE
REQUIRED AND TO REPEAL §34.24 OF THE FAYETTEVILLE CODE
WHEREAS, A.C.A. § 14-58-303 (b) requires the "municipal governing body
shall provide, by ordinance, the procedure for making all purchases which do not exceed
the sum of ten thousand dollars ($10,000.00)."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby
repeals §34.23 of the Fayetteville Code and replaces it with a new §34.23 changing the
dollar limit from $20,000.00 to $ 10,000.00 to comply with state law:
"§34.23 Purchases and contracts not in excess of $10,000.00.
All such purchases not in excess of $ 10,000.00 shall be
made by the mayor, or his duly authorized representative,
after the securing and recording of quotation bids therefor;
provided, quotation bids need not be secured for purchases
under $500.00. Contracts not in excess of $ 10,000.00 shall be
made and entered into by the mayor, provided the hiring or
engagement of professional services shall be conducted
according to a professional hiring policy approved by the
city council. The mayor shall have authority to approve
contract change orders up to the contingency amount, if any,
as set forth in any approved contract even though such
contingency amount may exceed $ 10,000.00."
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby
repeals §34.24 of the Fayetteville Code because purchases and contracts in excess of
$ 10,000.00 are governed exclusively by state law (A.C.A. § 14-58-303).

In most cases A.C.A. §14-58-303 (b) (2) controls the manner in
which a city contract in excess of $10,000.00 must be obtained . . .
" competitive bidding. " I have attached this statute.
A.C.A. §19-11-229 (b) was amended in 2001 to state that
" Contracts exceeding an estimated purchase price of twenty-five
thousand dollars ($25,000.00) shall be awarded by competitive sealed
bidding . . . . " This statute did not change A.C.A. §14-58-303 (b) (2)
which still requires competitive bidding for contracts above $10,000.00.
I believe the City is bound by this lower figure despite the raise
from $10,000.00 to $25,000.00 in the competitive bidding threshold in
A.C.A. §19-11-229 (b) .

14-58-302, Annual report by mayor,
(a) The mayor of a first class city shall prepare and submit to the
municipal governing body within sixty (60) days after the end of each
fiscal year a complete report on the finances and administrative
activities of the city during the previous fiscal year.
(b) The mayor shall also keep the governing body advised as to the
financial condition and future needs of the city and make such recom-
mendations as to him may be desirable.

14-58-303. Purchases and contracts generally.
(a ) In a city of the first class, the mayor or his duly authorized
representative shall have exclusive power and responsibility to make
purchases of all supplies, apparatus, equipment, materials, and other
things requisite for public purposes in and for the city and to make all
necessary contracts for work or labor to be done or material or other
necessary things to be furnished for the benefit of the city, or in carrying
out any work or undertaking of a public nature therein.
(b)( 1 ) The municipal governing body shall provide, by ordinance, the
procedure for making all purchases which do not exceed the sum of ten
thousand dollars ($ 10,000).
(2)(A)(i) Where the amount of expenditure for any purpose or con-
tract exceeds the sum of ten thousand dollars ($ 10,000), the mayor or
his duly authorized representative shall invite competitive bidding
thereon by legal advertisement in any local newspaper.
(ii) Bids received pursuant to the advertisement shall be opened
and read on the date set for receiving the bids in the presence of the
mayor or his duly authorized representative.
(iii ) The mayor or his duly authorized representative shall have
exclusive power to award the bid to the lowest responsible bidder, but
may reject any and all bids received.
(B) The governing body, by ordinance, may waive the requirements
of competitive bidding in exceptional situations where this procedure
is deemed not feasible or practical.
