The subject property is in the Deerfield Place Subdivision at Huntsville Rd. and Deerfield Way. The final plat was approved on June 11 , 1998. The final plat indicates the neighborhood as R- 1 Low Density Residential, except lots 1 , 2 and 34, 35, which are zoned R-O Residential Office. The R-O district has a 30' front setback and R- 1 has a 25 ' front setback. All single-family houses in the subdivision were built at the 25 ' front setback, including lots 2 and 34. Therefore, the structures were built 5 ' into the required 30' setback of the R-O district. Proposal: The applicant requests to rezone the property from the R-O district to the R- 1 district so that all residential structures are in the R- 1 district and compliant with the zoning regulations. Finding: The proposed zoning is consistent with the Future Land Us Plan, which designates these properties as residential. Also, the proposed zoning is • consistent with the other properties in the neighborhood, which are single- family residential. 2. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: The single-family homes already exist on -site. Rezoning the property so that the existing structures are compliant with zoning is justified. . 3. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: Findings of Planning: Using Trip Generation Rates, the average weekday volume would increase by 19 trips. Findings of Public Works: The proposed zoning may result in additional traffic volumes for this area, due to the potential change in land use. The access to the developed site and the circulation network within the development shall be reviewed in detail as part of the subdivision submission process or large scale development process. The layout, connectivity, circulation plan, ingress and egress provisions will be reviewed in detail as the information becomes available. Note: This site has been through the subdivision review process. 4. A. determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: Findings of Planning: The average household size in Fayetteville in 2000 was 2.21. Using this figure, the estimated increase in population from the two additional households is 4.42. During the development's review and approval process the adequacy of the existing infrastructure to accommodate the service requirements will be assessed by the developer's consultant and reviewed by city staff. Any inadequacies, lack of availability, need for improvements and determination of responsibility for the infrastructure improvements shall be resolved during the development's review/approval process. Findings of Fire Department: Estimated response time is 7 to 10 minutes for this location. Additional fire hydrants will be required. Streets with 20' of unobstructed width and cul- de-sacs with proper turning radius for vehicles. Findings of Police Department: The police department does not have any objection to the rezoning being granted.
