WHEREAS, Ordinance No. 4403 rezoned that property described in rezoning petition RZN 02-14.00 for a parcel containing approximately 3.12 acres located at the Northeast corner of Crossover and East Zion Road from A-1, Agricultural to R-O, Residential Office; and WHEREAS, changes in the location of the crematorium within the development have caused the need to amend the original legal description for that portion of the property to remain A-1, Agricultural. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . The applicant has requested this rezoning with the intention of developing a funeral home with a crematory. A funeral home is a use which is permitted by right within the R -O, Residential Office zoning district. However, the crematory is only permitted within the A-1, Agricultural district. This request will rezone a portion of the property that the applicant intends to develop which will leave part of the property properly zoned for the crematory on the site.
