AN ORDINANCE AMENDING CHAPTER 72: PARKING
REGULATIONS, CODE OF FAYETTEVILLE, TO
AUTHORIZE THE IMPOUNDMENT OF VEHICLES
ILLEGALLY STORED IN PUBLIC PARKING DECKS AND
LOTS; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That §72.02 (A), subsections (3) & (4) Impoundment
Procedures, are hereby repealed and the following is inserted in their stead:
§ 72.02 Impoundment procedures.
(3) When any vehicle is left unattended upon a street and is
parked illegally as to constitute a definite hazard or
obstruction to the normal movement of traffic; when
any vehicle is left continuously and unattended upon
any street, public parking deck or lot for a period of
more than 72 hours; and any time a vehicle is parked in
a prohibited area that is so designated by signs or other
official markings.
(4) When any vehicle is illegally parked on a public street,
parking deck or lot designated by a sign or by curb
marking as a tow-away zone.
Section 2. That §72.10, Parking Prohibited During Certain Hours on
Certain Streets, is hereby repealed and the following is inserted in its stead:
§ 72.10 Parking prohibited during certain hours on certain streets.
When signs are erected on any street or part of street in
each block giving notice thereof, no person shall park a
vehicle on any such street or part of street in each block so
designated between the hours specified by the signs, except
on weekends and public holidays.

Section 3. That §72.11, Stopping, Standing, or Parking Prohibited During
Certain Hours on Certain Streets, is hereby repealed and the following is inserted
in its stead:
§ 72.11 Stopping, standing, or parking prohibited during
certain hours on certain streets.
When signs are erected on any street or part of street in
each block giving notice thereof, no person shall stop, stand,
or park a vehicle on any such street or part of street in each
block so designated between the hours specified by the
signs, except on weekends and public holidays.
Section 4. That §72.12, Parking Time Limited to One Hour on Certain
Streets, is hereby repealed and the following is inserted in its stead:
§ 72.12 Parking time limited to one hour on certain streets.
When signs are erected on any street or part of street in
each block giving notice thereof, no person shall park a
vehicle on any such street or part of street in each block so
designated for longer than one hour at any time between
the hours of 7:00 a.m. and 6:00 p.m. of any day, except
weekends and public holidays.
Section 5. That §72.13, subsections (A) & (B), Two-hour Parking Zones;
Towing Procedures, are hereby repealed and the following is inserted in their
stead:
§ 72.13 Two-hour parking zones; towing procedures.
(A) The Parking Superintendent is hereby authorized to
determine the location of two-hour parking zones and to
place and maintain appropriate signs indicating the same
and stating the hours during which such limitations are
applicable. All such locations heretofore and hereafter
designated as two-hour parking zones shall be subject to
the provisions of this section.
(B) No person shall park any vehicle in any two-hour
parking zone located in the city for longer than two
consecutive hours during any four-hour period, except on
weekends and public holidays.

Section 6. That §72.99, subsection (B) Penalties, is hereby repealed and the
following is inserted in its stead:
§ 72.99 Penalties.
(B) The penalty for each violation of § 72.13, § 72.57, or §
72.58(J) shall be $5.00 if paid before the issuance of a
summons, citation, or arrest warrant; otherwise, the penalty
for each violation of § 72.13, § 72.57, or § 72.58(J) shall be
$25.00; provided the penalty for each violation of § 72.13, §
72.57, or § 72.580) in excess of five (5) in any calendar
month shall be $25.00 if paid before the issuance of a
summons, citation, or arrest warrant; otherwise, the penalty
for each violation of § 72.13, § 72.57, or § 72.580) in excess of
five (5) in any calendar month shall be $50.00.
Section 7. This ordinance shall not be effective until July 1, 2002.

SUBJECT: Parking Recommendations for Downtown/Dickson Street Area
Staff has been reviewing downtown parking issues since last summer to determine appropriate
changes needed to more efficiently utilize downtown parking and meet the needs of customers,
downtown merchants, and downtown employees. Last fall we held two public meetings to
gather public input concerning the needs for downtown parking. Since then, the City has
conducted various surveys to analyze parking issues and situations after the opening of the Town
Center, which alleviated most of the congestion around the square.
Upon further consideration of the findings, City staff and members of DDEP have jointly
determined that there is no immediate need for a parking deck to be constructed in the vicinity of
the square. However, there are several other changes that we can implement to ensure that our
current parking areas are being utilized appropriately. The attached recommendations were
compiled from the public meetings held last fall. Two more public meetings were held in March
to review these recommendations before going to city council. No changes were requested at
that time.
Please note, the two main items that the public requested was to raise the fines for parking
violations, AND to provide more free parking for downtown employees. There are only three
items in the following list of recommendations that require council approval. Because these
items amend three separate ordinances, we have presented them to you as three separate agenda
items.

PARKING RECOMMENDATIONS
DOWNTOWN/DICKSON AREA
CHANGES IN PROGRESS (INFORMATIONAL ONLY):
1 . Remove 36 parking meters in Lot 13 (See map: Attachment A); make this a free
lot for customers and downtown employees. This will be a loss of $4,400 in
annual revenues, but we project that the increased penalty for parking fines will
more than make up for any meter revenues lost.
2. After reviewing usage of free spaces in Lot 13 for 6 months, staff will consider
removing 14 on-street parking meters located on Block Ave. from Spring St. to
Dickson St. Staff may also consider removing another 25 on-street parking
meters located on East Ave. from Spring St. to Dickson St. These could all
become unlimited free parking for downtown employees and customers.
3 . Design and distribute informational brochures to downtown employees and
business owners. These brochures will be color-coded with all parking areas,
parking programs, and related costs. It would also provide education of the value
of customer parking and the necessity of ensuring that our downtown employees
do not use the "customer spaces".
4. Begin a "Streets are for Customers Campaign". Utilize parking enforcement
officers to provide POSITIVE public relations by assisting visitors and employees
in finding the appropriate parking areas. They will also assist with distributing
the downtown parking brochures.
5. Change 2-hour parking signs on square to state "2-Hour Customer Parking".
6. Issue a "Courtesy Ticket" for first-time offenders (only on square; not at meters).
We need to be courteous of our out-of-town visitors that may not be aware of our
2-hour parking ordinances. This ticket would not levy a fine, but would give a
gentle notification of our parking regulations. The courtesy ticket would also
welcome customers to our city, provide some very helpful tourist information,
and provide them with our new parking brochure that will direct them to the
appropriate parking areas depending on the anticipated length of their visit.
7. Revise lease zone in Lot 1 prescribed for 25 leased parking spaces. Set new zone
and allow staff to administer lease contracts internally. The number of leased
spaces will decrease by 1 space. This is necessary due to the trash container being
relocated from the north side of the lot, to a site just west of the transformer.
Lease spaces numbered 31 and 32 will need to be maintained as public spaces in
order to have restricted parking before 7 :00am to allow the solid waste trucks
access to the receptacle. Therefore, the Lessee for space number 32 has agreed to
relocate to another space; lease space number 31 is not currently being leased.
Please refer to Attachment B. 1 and B.2 for a diagram of Lot 1 and its revisions.
ORDINANCE CHANGES REQUIRING COUNCIL APPROVAL:
1 . Increase the current penalty for a parking violation from $2.00 to $5 .00. (Paying
a $2.00 ticket is more attractive that participating in a parking program because
you get to park all day on the square!) ORD. NO. 72.99
2. Change the parking enforcement hours on the square to be enforced from 7:OOam
to 6:OOpm (currently 8 :OOam to 6:OOpm). ORD. NO. 72. 13
3 . Adopt a "No Storage" ordinance. We should not allow any municipal parking lot
or parking deck to be used as a storage facility. At a price of $30.00 per month,
we have citizens purchase a parking card just to store their vehicles. We also
have experienced citizens using their parking card to enter their stored vehicle and
then reuse it daily for their every-day parking; two spaces for the price of one!
Downtown public parking is too precious to be used for storage. ORD. NO. 72.02

13. Ensure refusal to renew vehicle registration if parking fines are unpaid.
14. Provide detailed, color -coded maps and informational brochures that show
various parking areas, programs, and costs; distribute to citizens, downtown
employees, and downtown business owners.

SUBJECT: Ordinance to Increase the Penalty for Parking Violations
Staff recommends increasing the parking fines from $2.00 to $5.00 effective July 1, 2002. The
current penalty for a parking violation is not much incentive to get off the street. Nearly all of
the downtown merchants we have spoken with wholeheartedly agree that the fines need to be
raised and enforced. Now that the Town Center construction has ended, a large number of
parking spaces have been made available. Also, the City is making great strides to provide free
parking to downtown employees in areas that are only 2 blocks from the square. Downtown
employees may even park in the Town Center deck for as little as $1.00 per entry.
Now that we have affordable parking available to downtown employees, staff feels that
increasing the penalty for parking violations is our best tool to get the employees to park in the
appropriate areas. The spaces on the square need to be made available so that our customers get
the "front door"spaces.
Currently, by city ordinance:
The penalty for each violation shall be $2.00 if paid before the
issuance of a summons, citation, or arrest warrant. After such notice
is issued, the violation increases to $5.00.
We would change this to $5.00 and $25.00 respectively. The rest of the ordinance would remain
the same where habitual offenders are recognized with the provision that for each violation in
excess of five (5) in any calendar month, the violation shall be $25.00 if paid before the issuance
of a summons, citation, or arrest warrant. After such notice is issued for this type of
"superticket", the violation increases to $50.00.
These increased fines are not intended to penalize employees for working downtown, but to
encourage employees to utilize our parking programs and free up prime parking spaces for
citizens to be able to visit our downtown area. The City of Fayetteville has 7 parking lots
situated near the downtown square with over 700 metered or gated parking spaces. These are all
off the square and off the streets.
The success and viability of businesses on and around the square are contingent upon the
availability of parking spaces for their customers. According to Hyett Palma, a consulting firm
out of Alexandria, VA, a prime parking space in a downtown area is worth approximately $150 -
$300 in retail sales per day. "Based on this calculation, the cost per year to downtown retailers is
a loss of $45,000 - $90,000 per space when downtown business employees park in prime
downtown spaces. If only 10% of the City's on -street spaces are taken by downtown employees,
this results in lost sales of $1.4 million - $2.8 million annually."
The first step to resolving our parking problems are to get the downtown employees off the free
spots on the square. The only way to accomplish this is to encourage participation in our parking
programs, and discourage the price of paying a ticket.
ASSUMPTIONS:
Assuming that a downtown employee works 8:00am to 5:00pm, then that employee needs a
minimum of 9 hours to park each day. Here are their current parking options:
1. PARKING PROGRAM
A. Employee may sign up for one of our parking programs (hang tags or gated lots),
and park 1 to 3 blocks away from work.
B. Location: Lots 1, 3, 5, 7, 12, 13
C. Cost: $30/month
MUNICIPAL PARKING DECK AT HILTON
A. Employee may lease a space on 2"' level of the municipal parking deck (covered
parking).
B. Location: Lot 62
C. Cost: $45/month
TOWN CENTER PARKING DECK
A. Employee may lease a space at the Town Center parking deck (covered parking).
B. Location: Lot 10
C. Cost: $50/month
4. FEED THE METER
A. Employee can park at a meter 1 to 3 blocks away from work and feed the meter all
day long (closer meters are only 2 -hour meters so employee must return to feed
the meter every 2 hours or less). Long term meters are further away, but the cost
is less.
B. Location: All metered lots both on -street and off-street.
C. Cost: Approx. $45/month (short-term meters are 25 cents/hour; long-term meters
are 15 cents/hour)
ACCUMULATE/PAY PARING VIOLATIONS
A. Employee can park anywhere they want, including right on the square.
B. Location: Park anywhere! (Including square which needs to be available for
customers visiting downtown merchants.)
C. Cost: $30 - $60/month (4.00/day for 2 parking violations)

SUBJECT: Ordinance to Change Hours of Parking Enforcement on Square
Staff recommends that the Parking Enforcement staff begin enforcement of parking at 7:00am on
the square. The parking on the square is free parking and is limited to two consecutive hours.
The parking on the square is designed to allow customers visiting our downtown shops the
ability to come and shop without paying for parking. We continue to have downtown employees
park in these free spaces, leaving none available for the customers. Staff feels that is we can
begin the "timed parking" at 7:00am, then those employees that continue to park on the square
would have to move their vehicle off the square by 9:00am. This is the peak time customers start
arriving downtown.
Currently, the hours of parking enforcement are designated by ordinance from 8:00am to 6:00pm
for all parking zones. At this time we propose only changing those hours for the square to be
from 7:00am to 6:00pm effective July 1, 2002. The appropriate signs will be posted to notify the
public of the new enforcement times.

SUBJECT: Ordinance to Tow Abandoned Vehicles from Public Parking Lots
Staff recommends that we add a section to Ordinance No. 72.02 (Impoundment Procedures) that
allows the city to tow a vehicle that has been parked on a public parking lot for 48 consecutive
hours or more. We should not allow any municipal parking lot or parking deck to be used as a
storage facility. At a price of $30.00 per month, we have had citizens purchase a parking card
just to store their vehicles. We also have experienced citizens using their parking card to enter
their stored vehicle and then reuse it daily for their every -day parking of another vehicle (two
spaces for the price of one!). Downtown public parking is too precious to be used for storage.
The current ordinance on impoundment procedures authorized the police department to remove
the vehicle from the site. Therefore, the parking enforcement staff would first attach a "tow
notice" to the vehicle giving the owner 24 hours to move the vehicle; then they would notify the
police department to begin removal procedures. Retrieval of the vehicle will be at the owners
