HomeMy WebLinkAboutOrdinance 4382 ORDINANCE NO, 4382 AN ORDINANCE TO AMEND §50.40 (E) (1) OF THE CODE OF FAYETTEVILLE TO REVISE AND LOWER . THE CHARGE TO COMMERCIAL LANDSCAPERS AND TREE TRIMMERS FOR BRUSH DISPOSAL AT THE CITY'S COMPOSTING FACILITY WHEREAS, the previous charge of $3.50 per cubic yard of brush was difficult to administer and caused inconsistent charges; and WHEREAS, the Solid Waste Division studied this problem and recommends fees based upon the size and type of vehicles transporting the brush. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby repeals §50.40 (E) (1) and inserts the following language as the new subsection (E) (1): " §50.40 (E) (1) Businesses, including commercial landscapers and tree trimmers, and non-residents that bring brush to the city's composting facility for disposal will be charged as follows: (a) Compact pick-up trucks $ 5.00 (b) Full size pick-up trucks $ 8.00 (c) Trailers up to 14-feet long $ 10.00 (d) Trailers greater than 14 feet $ 15.00 PASSED and APPROVED this the 19th day of March, 2002. In became apparent last fall, toward the end of the growing season, that this rate had been inconsistently applied, when one lawn service company brought in several receipts from the City showing a variety of interpretations of the per cubic yard fee, from actual measurement to $3 .50 per load. During the winter the staff has evaluated the cost of processing and the value of the service, in order to have an ordinance amendment to the Council before the 2002 growing season began. Discussion It is the opinion of staff that the current cubic yar44ee of the Ordinance is excessive, but the other extreme of $3 .50 per undefined load i to I w. "The collection and removal of garbage and trash from any establishment other than single family residences. Commercial service shall include, but not be limited to: office buildings, private institutions, professional buildings, restaurants, apartments, duplexes and trailer parks." The solid waste and recycling division is currently servicing 16 trailer parks. Three of those 16 are being serviced by bin service as is stated in the section of the ordinance noted above. The remainder are being serviced as residential with pink bags and recycling bins. The ordinance further defines "Residential Service". The collection and removal of garbage and trash from all single-family residences located on public roadways within the City of Fayetteville. _Collection of earbaee and trash from residents on private roadways will be at the discretion of the city. The trailer parks should be converted to bin service. This would partially reduce the recycling volume of the already heavy recycling routes. This would also alleviate the need for additional manpower and vehicle to meet the expansion demands of the routes. As we develop a Commercial recycling program, we would be able to service the trailer parks with this system at a future date. There are approximately 16 private roads that we are required to pick up from. Some of these roads are kept in poor condition, have narrow bridges to cross or create an unsafe condition where our drivers must back out from the pickup point onto the street. We would like to discontinue this practice, and at the same time convert the trailer parks (which are also all on 2 private roads) to commercial bin service. The trailer park change would initially reduce the residential revenue source by $810.25 when converted to commercial service. The offset would be a decrease in hours from the recycling drivers. With your approval, we can start on this program, contacting each park and notifying the private street residents that they must start putting their refuse and recycling at the closest street from their private street entrance beginning April 1 , 2002. The charge of $3 .50 per loose cubic yard is extremely high - the current charge of $3.50 per load is extremely low.
