ORDINANCE NO. 4375
AN ORDINANCE DECLARING A VACANCY TO EXIST IN
THE OFFICE OF ALDERMAN FOR WARD TWO, POSITION
TWO, CALLING AND SETTING A DATE FOR THE SPECIAL
ELECTION TO FILL THAT POSITION, APPROVING A
BUDGET ADJUSTMENT AND DECLARING AN EMERGENCY
WHEREAS, Alderman Randy Zurcher was duly elected to the Fayetteville
City Council to serve a four year term beginning January 1, 2001, representing
Ward Two, Position Two; and
WHEREAS, Alderman Zurcher has announced he has left Ward Two and
in fact moved out of Arkansas effective March 1, 2002; and
WHEREAS, A.C.A. §14-43-411(b)(1) requires a successor to be elected by a
vote of the electors of the ward in a special election held within sixty days of the
date the vacancy occurs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas
hereby declares that on March 1, 2002, a vacancy in the office of Alderman, Ward
Two, Position Two, with more than a year remaining in the unexpired term, has
occurred.
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby orders that a special election to fill this vacancy and elect Alderman's
Zurcher's successor be held on the 23rd day of April, 2002, within Ward Two.
The filing period for this election shall be from March 6, 2002 until 3:00 P.M. on
March 18, 2002.
Section 3. That the City Council of the City of Fayetteville, Arkansas
hereby directs the City Clerk to advertise this special election and do all other
things necessary so that this special election can be conducted and approves a
budget adjustment (attached as Exhibit A) in the amount of $6,000.00 to pay the
costs of this special election. A copy of this ordinance shall be furnished to the
Washington County Board of Election Commissioners.

Section 4. That the City Council of the City of Fayetteville, Arkansas
hereby determines that the statutory requirements to conduct such a prompt
special election require that this ordinance go into effect immediately after its
adoption to preserve the vital constitutional rights to vote and campaign for
election. Therefore the City Council declares an emergency exists so that this
ordinance being necessary for the public safety and welfare shall be in full force
and effect from and after its passage and approval.
