AN ORDINANCE WAIVING THE REQUIREMENTS OF
FORMAL COMPETITIVE BIDDING FOR THE
CONSTRUCTION OF UTILITY DUCT BANKS AT THE NEW
PUBLIC LIBRARY SITE.
WHEREAS, the Code of Fayetteville requires that utilities servicing new
construction be placed underground, and;
WHEREAS, AEP/SWEPCO requires that only pre-qualified contractors perform
trenching work on their lines, and;
WHEREAS, repeated opening of the trenches by successive contractors would pose
an increased risk to the health and safety of the construction crews, and;
WHEREAS, the City Council finds that such circumstances constitute an exceptional
situation where competitive bidding is not feasible or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby waives the requirements of formal
competitive bidding for the construction of utility duct banks at the new public library site.

Subject: Ordinance waiving requirement for competitive bidding on the site
improvements for the new Fayetteville Public Library: Utility Duct Banks, 401
West Mountain
Background:
Existing overhead utilities along School and West Avenues between Mountain
and Rock Streets will be buried as part of the library project. Utilities include
power, telephone, cable and a University of Arkansas fiber optic cable. All ducts
for these utilities can generally be located in the same trench. The power
company, AEP / SWEPCO, has exacting requirements which demand the
contractor for electric power ducts and vaults be approved by AEP / SWEPCO. It
would not be feasible or safe and would be more expensive to have different
contractors digging numerous times in the same trenches.
Request:
The request is to bid this work to pre-qualified contractors currently approved by
AEP/SWEPCO. The bid would be divided into two components 1 ) electric power
ducts and vaults and 2) telephone, cable and fiber optic ducts. Award would be
to the lowest responsible bidder whose total for these two components is the
least cost.
