property located east of Double Springs Road and south of Owl Creek Subdivision. The
property is in the Planning Area and contains approximately 13.61 acres. The request is to
annex into the city.

BACKGROUND
The subject property is located at the western edge of the city, south of Hwy 16W on Double
Springs Road. Recently property west and south of this tract was annexed and zoned R- 1 for the
Silverthome Subdivision. The two different property owners have obtained an order of
annexation from Washington County and are now requesting that the 13 .61 acres be annexed into
the City of Fayetteville. Two companion requests are also being brought to the Planning
Commission for consideration. These property owners, along with the owner of property to the
north, are requesting that the entire parcel be rezoned from A- 1 , Agricultural, to two different
types of residential zoning designations.
Surrounding properties are predominately large acreages with single family homes and some
agricultural uses.
Annexation will allow for the controlled development under current City regulations. Tree
preservation, park land dedication, stormwater management and grading and drainage, will all
apply at the time of development for this property if it is annexed into the City. During
development review utilities are coordinated. More efficient use of infrastructure is a positive
result of development under City regulation. The developer will benefit by having the
opportunity to better utilize the subject property and gain access to the City's sewer system as
well as police and fire protection and solid waste pickup.

Subdivision (R- 1 )
INFRASTRUCTURE:
Access to this property is from Double Springs Road which runs along the western property
boundary and intersects Wedington Drive / Hwy 16W to the north and Hwy 62W to the south
(through Farmington). Double Springs Road in this location is classified a minor arterial on the
City's Master Street Plan. A minor arterial requires a total of 90' of right of way and is designed
to carry approximately 12,200 vehicles per day. Persimmon, a proposed collector street on the
Master Street Plan lies immediately north of the subject property.

An existing 8" water line along the west side of Double Springs Road is available to serve this
site. Sewer will have to be brought to the site at the time of development. A lift station and a
12" sewer line are located north of this property which serve nearby residential subdivisions
(Silverthome, Owl Creek).
LAND USE PLAN: General Plan 2020 designates this site Residential.

approximately 13 .61 acres. The request is to annex into the city. Staff recommends
approval of the requested annexation based on the findings that are included in your

Smith: My name is Raymond Smith, I'm an attorney representing both the Griscoms and the
Guists in this petition for annexation of 13 .61 acres from the county into the City of
Fayetteville. I believe the packet there has quite a bit of material in there. If there are any
questions as far as the developer on this or the planning people on this, Mr. Jorgensen,
they are in the audience here and would be available to answer any questions.

5. Pursuant to Arkansas Code Annotated Sections 14-40-601 et seq. this Court has jurisdiction
over the subject matter herein, and Petitioners request that the above -described be annexed to the City
of Fayetteville.
6. Petitioners further state that the law firm of Raymond C. Smith, P.A., Fayetteville, Arkansas, is
authorized to act for and on behalf of the Petitioners in all matters connected with this Petition and
subsequent hearings or annexation proceedings connected herewith.
7. Petitioners request that this Court set a date for hearing on this Petition, not less than thirty
days after the filing of this Petition and subsequent hearings or annexation proceedings therewith.
WHEREFORE, Petitioners pray that the above -described property be annexed to the City of
Fayetteville, Washington County, Arkansas, pursuant to the provisions of Arkansas law, after a hearing
thereon as required by law; and that this Court, by Order, fix a time and place for said hearing not less

Immediate impact would be minimal. Sidewalk construction would be required as development
occurred, with the cost born by the developer/owner.
If street improvements (to existing County roads) were made by the City then sidewalk
construction costs would be included with the street improvements.
All future maintenance cost for sidewalk repairs would be born by the City.

Currently, the Parks and Recreation Division has three parks in the general vicinity of this
property: Bundrick Park, Red Oak Park and Ozark View Park. Ozark View Park is located next
to the site of the new Fayetteville Boys and Girls Club.
Statement regarding the impact of the proposed annexation on the level and/or type of
service provided by your division:
This proposed annexation, rezoning and future residential development would have an impact on
the level of service required by the Parks and Recreation Division. The Park Land Dedication
Ordinance would be applicable at the time of development. The Park Land Dedication
Ordinance, with figures provided, would require an estimated 5.21 acres of new park land, unless
a money -in -lieu wavier was requested by the Parks and Recreation Advisory Board. Estimated
development cost for the new parkland would range from $75,000 to $300,000, depending on the
needs of the community. Yearly maintenance costs for mowing, trash pick-up, playground
maintenance and equipment repair would be approximately $15,000 to $20,000.
