HomeMy WebLinkAboutOrdinance 4322 ORDINANCE NO. 4322 AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF PUBLIC RECREATION SERVICES FOR THE CITIZENS OF FAYETTEVILLE FROM THE FAYETTEVILLE YOUTH CENTER, INC. D/ B/ A FAYETTEVILLE BOYS AND GIRLS CLUB, INC. THROUGH THE END OF 2001 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . The City Council hereby waives the requirement of competitive bidding for the purchase of public recreation services for the citizens of Fayetteville from the Fayetteville Youth Center, Inc. d/ b/ a Fayetteville Boys and Girls Club, Inc. through the end of 2001 for the reason that an exceptional situation exists making competitive bidding not feasible for the following reason: (a) The Fayetteville Youth Center, Inc. d/b/ a/ the Fayetteville Boys and Girls Club, Inc. has been operating pursuant to a Working Procedures and Responsibilities agreement with the City of Fayetteville to provide public recreation to Fayetteville youth. It would be highly disruptive to the public recreation program partially funded by the City of Fayetteville to require competitive bidding in the middle of the year when both parties are relying upon a previously approved budgeted amount for promotion, development and operation of the Fayetteville Youth Center, Inc. through the end of 2001 . Section 2. The City Council hereby determines that the City of Fayetteville is in immediate and continuing need of the public recreation program of the Fayetteville Youth Center, Inc. and hereby determines that the immediate passage of this ordinance is necessary for the purchase of such services. Therefore, an emergency is declared to exist and this ordinance being 0 ord . 4322 necessary for the public peace, safety and welfare shall be in full force and effect from and after its passage and approval. _PASSED and APPROVED this 191h day of June, 2001 .
