AN ORDINANCE REPEALING ORDINANCE NO. 3865 WHICH AUTHORIZED THE CITY COUNCIL TO SET PRICES FOR THE SALE OF GIS COMPUTER MAPPING AND REPEALING RESOLUTION NO. 10.95 WHICH SET SUCH PRICES. WHEREAS, Ordinance No. 3865 authorized the city to set prices for the sale of GIS Computer mapping in 1995 and; WHEREAS, Resolution 10-95 set prices for the sale of such mapping and; WHEREAS, only a marginal percentage of the cost of the GIS has been recovered and; WHEREAS, computer technology now allows easy access and distribution of such information that was unavailable in 1995 and; WHEREAS, the City Council deems it to be in the greater interest of the public to allow citizens to more readily acquire and use geographic information by supplying it at the nominal cost of the media requested or distributed freely over the City of Fayetteville website. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That the Ordinance No. 3865 passed and approved on January 17, 1995 authorizing the City Council to set the schedule of prices for the sale to the public of certain computer mapping products (the Geographical Information System) produced by the City of Fayetteville and to declare an emergency is hereby repealed in its entirety. Section 2. That Resolution No. 10-95 setting prices for the sale of aerial photographs and certain computer mapping products (geographical information systems) produced by the City of Fayetteville is hereby repealed in its entirety. WHEREAS , by Ordinance No. 3665 passed and approved on the 17th day of January, 1995 , the City Council of the City of Fayetteville approved the sale of portions of the City 's recently developed digital aerial photographs, topographic/planimetric, and cadasral data system known as the Geographic Information System upon entry of a License and Nondisclosure Agreement with the City Fayetteville by prospective purchasers ; and WHEREAS , the process to be charged for products developed and generated by the City upon request of any member of the public shall be as set forth herein below until such time as a resolution is passed by the City Council amending said price list. NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 .
