AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING; AND APPROVING A COST SHARE
AGREEMENT WITH HOPKINS, INCORPORATED, THE
DEVELOPERS OF THE HOPKINS RETAIL CENTER IN THE
AMOUNT NOT TO EXCEED $82,350.00 FOR THE
INSTALLATION OF A TWELVE INCH WATERLINE ACROSS
WEDINGTON DRIVE AND ALONG THE WEST SIDE OF
GARLAND AVENUE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the City Council hereby waives the requirements of competitive
bidding for a cost share agreement, in the amount not to exceed $82,350.00, for installation of a
twelve inch waterline across Wedington Drive and along the west side of Garland Avenue for the
reason that said requirements are neither practical nor feasible. The developers are doing work on
their project, and to provide continuity and avoid duplication of work, will provide all labor,
materials, and equipment on the project.
Section 2. That the City Council hereby approves a cost share agreement with Hopkins,
Incorporated, the developers of the Hopkins Retail Center, for the installation of a 12" waterline
across Wedington Drive and along the west side of Garland Avenue. A copy of the agreement is
attached hereto as Exhibit "A".

AGREEMENT
This shall serve as a formal agreement between Hopkins, Incorporated and the City of
Fayetteville in order for the City of Fayetteville to participate in a cost share to install a 12"
waterline across Wedington Drive along the west side of Garland Avenue with Mike Hopkins of
Hopkins, Incorporated.
The City agrees to pay for a portion of the waterline extension up to a maximum City cost of
$82,350.00 as was bid by Fayette Tree & Trench, Incorporated with a ten percent ( 10%)
contingency.
It is understood that the contract for construction is between Hopkins, Inc. and his Contractor and
that the City has no contractual obligation with the Contractor. The City' s only obligation shall
be to participate in a cost share not-to-exceed amount of $82,350.00 maximum cost to the City.
It is further understood that upon acceptance of the water line system, Hopkins, Inc. will provide,
to the City, a copy of the invoice(s) from the Contractor and a completed lien waiver executed by
the Contractor. Within thirty (30) days after receipt of the invoice(s) and lien waiver, the City
shall make all efforts to remit the agreed upon cost share amount to Hopkins, Incorporated.
If the cost-share is approved by the Mayor and City Council, the city agrees to pay the actual and
verified construction (only) cost up to a maximum cost of $82,350.00. If the actual construction
costs exceed the maximum, the cost share shall be required to be reevaluated and re-approved by
the Mayor and/or City Council as appropriate.

Re: Proposed Cost-Share in the amount of $82,350.00 with Hopkins, Inc. the developers of
the Hopkins Retail Center for the installation of a 12" waterline across Wedington Drive
and along the west side of Garland Avenue.
The Hopkins Retail Center Large Scale Development was approved at the November 9, 1998
Planning Commission Meeting to be located at the southwest comer of the Wedington
Drive/Garland Avenue intersection. The original design for this project included extending an
eight inch (8") waterline from Hall Avenue to this site which was approved by the Engineering
Division. Recently, the City hired the Engineering Firm of Hawkins-Weir to design plans to
relocate the water and sewer along Garland Avenue which is scheduled to be widened by the
Arkansas Highway & Transportation Department in the year 2001 . The design by Hawkins-
Weir included extending a 12" waterline along the west side of Garland Avenue and across
Wedington Drive to connect to an existing 12" waterline on the north side of the road. It is the
Engineering Division's recommendation that the City Cost-Share with this developer to
eliminate the duplicated effort and have a portion of the 12" waterline installed at this time. The
developer would be responsible in paying for the cost of the waterline that was originally
proposed and approved by the Engineering Division.
Therefore, upon the recommendation of the Engineering Division, the City is requested to cost-
share with Hopkins, Incorporated to install a 12" waterline across Wedington Drive and along the
west side of Garland Avenue. The actual construction bids have been submitted for this
construction as follows:

Developer $ 33, 199.50
Total $ 108,067.00

A ten percent (10%) contingency was added to the City's portion for a total request of
$82,350.00 for this construction.
Based upon the information provided by the Budget & Research Division, there is a remaining
balance of $511 ,746.00 in the Garland Avenue Water & Sewer Relocation Account.
The final costs to the City will be based upon actual costs as documented by the developer's
engineer subject to review by the City and may, or may not exceed the Developer's
estimate. However, the City's share will not exceed the estimated costs without additional
authorization.
