AN ORDINANCE AMENDING CHAPTER 50: GARBAGE AND
TRASH, OF THE CODE OF FAYETTEVILLE, TO PROVIDE FOR
DISTRIBUTION OF 90, 33 GALLON, RESIDENTIAL GARBAGE
BAGS IN THE YEAR 2001 .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That §50.20, B., a., of the Code of Fayetteville, is hereby deleted and the
following shall be inserted in its stead:
§50.20 Service Requirements.
B. Residential Service
a. The City shall supply each resident receiving residential garbage
service with a quantity of 90, 33 gallon, residential garbage bags in the year 2001 .
Section 2. Solid Waste staff will present a long range plan for the volume based program
by May, 200.1 , to the Fayetteville City Council.

SUBJECT: Volume Based Program - 2001
Staff requests approval to amend Ordinance Number 4111 , 50.2, B, 1 , a.. This section of ordinance
states the City shall supply each resident receiving residential garbage service with a quantity of
residential garbage bags every twelve months, beginning January 2000. 104 bags will be supplied
each resident in the first year and 78 bags will be provided each resident in future years. Staff
would like to amend the last sentence to state: 104 bags will be supplied to each resident in future
years. This will increase the number of garbage bags to be supplied to each resident from 78 to 104
in 2001 and future years.
The Environmental Concerns Committee requested the implementation of volume based program,
in an effort to provide a more equitable solid waste billing system, reduce the amount of garbage the
City was placing in a landfill, and increase recycling efforts throughout the residential sector. To
date, the program has proved to accomplish these goals.
Equity Prior to implementing the volume based program, residents could dispose of an unlimited
amount of garbage for a flat monthly fee. With an unlimited disposal system, one resident can place
ten garbage bags out for collection each week while his neighbor places two bags out for collection,
and they both pay the same flat monthly fee. The volume based program provides a more equitable
system. It allows a specified quantity of disposal each year for a monthly fee of $9.25. Residents
needing more disposal capacity than allowed must pay more. The current system does not provide
a monetary advantage to residents who generate one bag of waste per week; however, it does provide
a more equitable system for the majority of residents.
Reduced landfill disposal The waste generation in the residential sector has become more
consistent, with the majority of our residents placing, on average, two garbage bags at curbside for
collection each week. The residential waste stream has been reduced by 16% since implementing
the volume based program.

Increased Recycling Efforts Participation in the curbside recycling program has increased
tremendously since implementing the volume based program. Staff estimates a city wide
participation rate of 85%, with some neighborhoods reaching 95%. The volume of materials
collected has increased beyond expectations. Households that were putting out a recycling bin half
full before the volume based program are now putting out one, often two, recycling bins
overflowing. Staff has been very pleased with the impact the volume based program has had on the
recycling program.
Survey Staff released a city wide survey requesting response to eight questions and allowing space
for written comments. To date we have received approximately 4,000 surveys. The survey results
indicate that 84% of the respondents do not use more than two bags. The survey also indicates that
46% of the respondents would like a larger bag, so that it will fit over a standard 32 gallon garbage
can. The survey indicates that 94% of the respondents participate in our curbside recycling program.
The majority of the respondents provided written comments, which have been very valuable in
evaluating the program. The two most common comments are on the size of the bag and the
reduction to 78 garbage bags in the year 2001 .
The City distributed 30 gallon bags in 2000. The most common complaint received is that a 30
gallon bag will not fit a standard 32 gallon garbage can. Staff agrees with this concern. Many
residents have also commented that they would like a smaller bag, and more of them. They indicated
that the large bags do not fit a standard kitchen can ( 13 gallons) and the 30 gallon bag is too heavy
when full. Staff agrees with this comment as well. Staff recommends distributing 104, 33 gallon,
garbage bags to each household. Staff further recommends allowing residents to trade 33 gallon
bags for 13 gallon bags if that size better fits their household. We would allow residents to exchange
their bags after distribution. We will distribute the 104 bags in two rolls of 52 bags. Residents
would be allowed to exchange their bags in rolls of 52. Specifically, they could exchange all 104
bags or a single roll of 52 bags. Residents would be allowed to exchange 104, 33 gallon, bags for
264, 13 gallon bags, or 52, 33 gallon, bags for 132, 13 gallon, bags.
Cart Pilot The two most common collection methods used in volume based programs are the use
of either specified garbage bags or plastic garbage carts. A bag program was selected for
Fayetteville. However, we believe it is important to further evaluate the use of carts. The Solid
Waste Division recently completed a pilot program using 60 gallon carts and automated collection
equipment. The pilot was conducted in an area with approximately 240 households. Carts were
issued to every household and for a six week period, participants were requested to use the carts
instead of purple bags. Semi-automated and fully-automated equipment was used for collection. We
released surveys to all participants in the cart pilot. We received 142 responses to the 240 surveys
sent to participants. The survey indicated that 88% of the respondents prefer to use the cart instead
of purple bags. Additional responses include, 91 % indicated carts are easier than bags to use, 65%
would support a $2 per month increase to support changing to a cart system and 58% would be
willing to purchase the carts themselves. We plan to conduct a second pilot in the west and
southeast areas of Fayetteville in October.
Summary Recommendation The volume based program has provided more equity and increased
recycling efforts in our residential waste collection program. The program overall has been accepted
well by the community and they continue to support the City's recycling program. Staff does not
believe it is justified to reduce the number of bags issued to 78 at this point. This would not make
the program more equitable (because it still does not address those producing one bag of waste per
week); it would only make the program more restrictive. Staff believes it would be better to issue
104 garbage bags to each household in 2001 and continue evaluating the program next year. This
would allow staff to continue educating our community, conduct another cart pilot and develop a
long range plan for the volume based program in the future, which will include addressing the issue
of those producing one bag of garbage per week.
In conclusion, staff recommends amending the ordinance to allow for the distribution of 104 garbage
bags in 2001 and future years. Staff also requests approval to increase the size of the bags to 33
gallons and implementation of an exchange program. Staff will present these recommendations to
the Environmental Concerns Committee prior to the September 5, City Council meeting. Staff will
