IN REZONING PETITION RZ 00- 16 FOR A PARCEL
CONTAINING APPROXIMATELY 4.21 ACRES LOCATED AT
1530 ALBRIGHT ROAD AS REQUESTED BY ARDEN GALE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the zone classification of the following described property is hereby
changed as follows:
From A- 1 , Agricultural District to R-1 , Low Density Residential District for the real
property described in Exhibit "A" attached hereto and made a part hereof.
Section 2. That the official zoning map of the City of Fayetteville, Arkansas, is hereby
amended to reflect the zoning change provided in Section 1 above.

Beginning at a point that is N 89°43'E 660.0 feet from the Southwest corner of the

acres. The request is to rezone to R- 1 , Low Density Residential.
Odom: The next item on tonight's agenda is RZ 00- 16.00 submitted by Arden Gale for
property located at 1530 Albright Road. The property is zoned A- 1 , Agricultural
and contains approximately 4.21 acres. The request is to rezone to R- 1 , Low
Density Residential. Staff recommends approval of the requested rezoning based
upon the findings in their report. Staff do you have anything further?
Conklin: This is a rezoning request from A-1 to R- 1 and contains 4.21 acres on Albright
Road in the northeast part of town. There is a single family home currently on
this lot and they have requested the R-1 zoning to bring forward a future lot split
on this property.
Odom: I would ask the applicant to please come forward at this time. Now, you don't
have to but do you have any presentation that you would like to make to us?
Gale: No sir.
Odom: And your name for the record?
Gale: Arden Gale.

Odom: Let me ask if there are any members of the audience that would like to address us
on this rezoning request?

Odom: Seeing none I will close the floor to public discussion and bring it back to the
Planning Commission for questions, comments or motions.

Shackelford: Mr. Chairman, I make a motion we approve RZ 00- 16 based upon staff
recommendations.

Odom : We have a motion by Commissioner Shackelford and a second by Commissioner
Hoffman. Do we have any further discussion:
Bunch: Mr. Chairman, this is more of a comment and primarily for the record. Since this
does not have sewer service we need to take a strong look for it at the lot split as it
comes through, should the City Council approve this, then the next action would
be the lot split that has already been filed, to make sure we have the proper septic
systems. Normally in the city we don't address septic issues so we need to make
sure this is on the record to notify people when it does come up before
Subdivision Committee that it is properly addressed with the septic
considerations.
Odom: Thank you Commissioner Bunch. Any further discussion? Call the roll.

Upon roll call the motion to recommend approval carries 9-0-0.
Odom: You have to go to the City Council now. They are the ones that make the
decisions on the rezonings.

BACKGROUND:
This property is located at the extreme northeastern boundary of the City of Fayetteville and
adjoins Springdale on three sides. To the south, across Albright Road, the property adjoins large
acreages with single family homes. This land to the south is located within Fayetteville and is
zoned A- 1 , Agricultural.
At this time, the applicant is seeking R- 1 , Low Density Residential zoning, the 4.21 acre tract is
currently zoned A- 1 , Agricultural. Currently there is one single family home on the property
with accessory buildings. This home is located in the southwest corner of the acre tract. The
property has quite a bit of topography, leading to Clear Creek which borders the tract to the
north.
The applicant is seeking to rezone the acreage in order to split the property into two lots. While
there is sufficient land area, the property does not have adequate frontage on Albright Rd. to
create two lots within the A- 1 district. A lot split request has been processed and is scheduled to
be heard by the Subdivision Committee on June 29, 2000. This lot split request will be
contingent upon approval of the rezoning by Planning Commission and City Council.

Streets: Access is provided via Albright Road. This is a county road and is not designated

Sewer: Not available - private septic system serves existing home
LAND USE PLAN: General Plan 2020 designates this site Residential. Rezoning this property
to R- 1 , Low Density Residential is consistent with the land use plan and compatible with
surrounding land uses in the area.
