AN ORDINANCE APPROVING A COST SHARE
AGREEMENT WITH MARK FOSTER AND J.B. HAYES IN
THE AMOUNT OF $335205 FOR AN UPGRADE TO A
WATERLINE WITHIN SUMMERSBY SUBDIVISION; AND
WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That a cost share agreement with Mark Foster and J.B. Hayes in the amount
of $33,205 for an upgrade from an eight inch waterline to a twelve inch waterline within
Summersby Subdivision. A copy of the cost share agreement is attached hereto as Exhibit "A" and
made a part hereof.
Section 2. That the City Council hereby waives the requirements of competitive
bidding for the upgraded waterline within the Summersby Subdivision that the City hereby agrees
to cost-share in, for the reason that said requirements are neither practical nor feasible. Mark Foster
and J.B. Hayes, as developers of Summersby Subdivision, submitted plans to extend an eight inch
waterline within the subdivision and will be providing all labor, materials, and equipment for
construction of the waterline.

AGREEMENT 4!9-x�
This shall serve as a formal agreement between the developers of the Summersby Subdivison, AORF
Mark Foster and J.B. Hays, and the City of Fayetteville in order for the City of Fayetteville to
participate in a cost share to upgrade a portion of the proposed waterline from 8" to 12" within
this development.
The City agrees to pay for the upgrade up to a maximum City cost of $33,205 .00 as was
estimated by Jorgensen & Associates. This includes $3 ,200.00 for additional engineering and
construction inspection. Mark Foster, J.B. Hays, and their Engineer agree to provide the
necessary and normal project management, inspection and testing as necessary for a complete
and accepted water line and appurtenances.
It is understood that the contract for construction is between Mark Foster and J.B. Hays and their
Contractor & Engineer and that the City has no contractual obligation with both the Contractor
and Engineer. The City's only obligation shall be to participate in a cost share not-to-exceed
amount of $33,205.00 maximum cost to the City.
It is further understood that upon acceptance of the water line system, Mark Foster and J.B. Hays
will provide, to the City, a copy of the invoice(s) from the Contractor and a completed lien
waiver executed by the Contractor. Within thirty (30) days after receipt of the invoice(s) and lien
waiver, the City will remit the agreed upon cost share amount to Mark Foster and J.B. Hays.
If you agree with these provisions please sign this agreement in the space provided and return to
the City.

Proposed Bid Waiver and Cost-Share in the amount of $33,205 .00 with the developers of
Summersby Subdivision for the construction of a twelve inch (12") waterline.
The Preliminary Plat for the Summersby Subdivision was approved by the Planning Commission
on June 24, 1999. The engineer for the subdivision planned to construct an eight inch (8")
waterline from Manor Drive northward through the proposed subdivision and connect to an
existing waterline located to the east of Broadview Subdivision. Due to frequent waterline
failures in this area and the proximity to a recommended waterline as shown on the Master Water
Plan, the Engineering Division and the Water/Sewer Superintendent have agreed that a 12"
waterline should be installed in lieu of an eight (8") waterline If such agreement were to fail, the
developer would only be responsible for constructing an eight inch (8") waterline.
Therefore, the City is requested to pay the difference to construct a twelve inch ( 12") waterline in
lieu of an eight inch (8") waterline. Jorgensen & Associates has estimated these costs as follows:
City $ 33,205 .00
Developer $ 36, 145 .00
Total $ 69,350.00
Based upon the information provided by the Budget & Research Division, there is a remaining
balance of $80,000.00 in the Water & Sewer Cost Share Account.

The final costs to the City will be based upon actual costs as documented by Jorgensen &
Associates subject to review by the City and may, or may not exceed the Engineer's estimate.
However, the City's share will not exceed the estimated costs without additional authorization.

SUMMARY OF APPROVALS

The following is a summary of the approvals for this subdivision that is presently under
construction:
* September 31 , 1999 - Southern Drainage Improvements
November 3 , 1999 - Partial/Phased Grading Permit
December 23 , 1999 - Water/Sewer Approval
January 14, 2000 - Streets/Drainage Approval
*It was required that the southern drainage be installed before any construction could begin
within the subdivision in order to protect the adjacent property owners. Therefore, the southern
drainage plans and calculations were submitted and approved before the subdivision construction
plans were submitted for review. A partial/phased grading permit was only given to the
developer after the southern drainage was installed to the satisfaction of the City Engineering
Division and after approval was provided from the adjacent property owner.
