AN ORDINANCE APPROVING A COST SHARE
AGREEMENT WITH MR. JAMES MARTIN IN THE AMOUNT
OF $26,380 FOR AN UPGRADE TO A WATERLINE ALONG
MALLY WAGNON ROAD ; AND WAIVING THE
REQUIREMENTS OF COMPETITIVE BIDDING.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the a cost share agreement with Mr. James Martin is hereby approved
in the amount of$26,380 for an upgrade from a two inch waterline to an eight inch waterline along
Mally Wagnon Road. A copy of the cost share agreement is attached hereto as Exhibit "A" and
made a part hereof.
Section 2. That the City Council hereby waives the requirements of competitive
bidding for the upgraded waterline along Mally Wagnon Road that the City hereby agrees to cost-
share in, for the reason that said requirements are neither practical nor feasible. Mr. James Martin
submitted plans to extend a two inch waterline along Mally Wagnon Road in order to receive City
water and will be providing all labor, materials, and equipment for construction of the waterline.

EXHIBIT A
AGREEMENT
This shall serve as a formal agreement between James Martin and the City of Fayetteville in
order for the City of Fayetteville to participate in a cost share to upgrade the proposed waterline
from 2" to 8" along Molly Wagnon Road and to provide two (2) fire hydrants with James Martin.
The City agrees to pay for the upgrade up to a maximum City cost of $26,379.71 as was
estimated by Jorgensen & Associates. This includes $ 1 ,750.00 for additional engineering and
construction inspection. Mr. James Martin and his Engineer agree to provide the necessary and
normal project management, inspection and testing as necessary for a complete and accepted
water line and appurtenances.
It is understood that the contract for construction is between James Martin and his Contractor &
Engineer and that the City has no contractual obligation with both the Contractor and Engineer.
The City's only obligation shall be to participate in a cost share not-to-exceed amount of
$26,379.71 maximum cost to the City.
It is further understood that upon acceptance of the water line system, James Martin will provide,
to the City, a copy of the invoice(s) from the Contractor and a completed lien waiver executed by
the Contractor. Within thirty (30) days after receipt of the invoice(s) and lien waiver, the City
will remit the agreed upon cost share amount to James Martin.

the City.

Proposed Bid Waiver and Cost-Share in the amount of $26,380.00 with James Martin for
the construction of an eight inch (8") waterline along Mally Wagnon Road.
A resident located on Mally Wagnon Road, Mr. James Martin, submitted plans to extend a two
inch waterline along Mally Wagnon Road in order to receive City water. The Engineering
Division and the Water/Sewer Superintendent both agree that this line should be upgraded to an
eight inch (8") diameter waterline to provide for growth along this road in the future and to
provide a looped waterline for the existing residents along both Ed Edwards Road and Van
Hoose Drive. If this cost-share agreement were to fail, Mr. James Martin would only be
responsible for the construction of a two (2") waterline.
Therefore, the City is requested to pay the difference to construct an eight inch (8") waterline in
lieu of a two inch (2") waterline. Jorgensen & Associates has estimated these costs as follows:
City $265380.00
Mr. Martin $ 13,000.61
Total $399380.61
Based upon the information provided by the Budget & Research Division, there is a remaining
balance of $80,000.00 in the Water & Sewer Cost Share Account.

The final costs to the City will be based upon actual costs as documented by Jorgensen &
Associates subject to review by the City and may, or may not exceed the Engineer' s
estimate. However, the City's share will not exceed the estimated costs without additional
authorization.

WHEREAS, the City of Fayette-
ville. Arkansas has created a
Public Facilities Board, and,.
pursuant to the Arkansas Public
Facilities Board Act, Ark, code
ann. §§14-134-101, et seq.,
has authorized the Public Fa-
cilities Board to issue revenue
bonds to finance construction of
residential housing, health care
and related facilities provided
said facilities are owned by
non-profit corporations or asso-
ciations; and
WHEREAS, the Arkansas Pub-
lic Facilities Board Act authoriz-
es a public facilities board cre-
ated by a municipality to issue
revenue bonds for the purpose
of financing construction of rec-
reational and tourist facilities
and privately owned residential

City Council has determined
