IN REZONING PETITION RZ99-31 .00 FOR A PARCEL
CONTAINING APPROXIMATELY 8.37 ACRES LOCATED
SOUTH OF APPLEBY ROAD AND EAST OF APPLEBY
APARTMENTS AS REQUESTED BY DAVE JORGENSEN OF
JORGENSEN AND ASSOCIATES ON BEHALF OF BLEAUX
BARNES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS :
Section 1 . That the zone classification of the following described property is hereby
changed as follows:
From A- 1 , Agricultural, to R- 1 , Low Density Residential, for the real property
described in Exhibit "A" attached hereto and made a part hereof.
Section 2. That the official zoning map of the City of Fayetteville, Arkansas, is hereby
amended to reflect the zoning change provided in Section 1 above.

Associates on behalf of Bleaux Barnes for property located south of Appleby Road and east of
Appleby Apartments. The property is zoned A- 1 , Agricultural and contains approximately 8.37
acres. The request is to rezone the property to R- 1 , Low Density Residential.

BACKGROUND :
The applicant requests the rezoning of approximately 8.37 acres from A- 1 to R- 1 (Low Density
Residential). The owner is Paul Martin and the applicant is Bleaux Barnes. The property has
564 feet of frontage on Appleby Road and is located between apartments to the west and Quail
Creek Subdivision/single family homes to the east.
ADJACENT LAND USE AND ZONING:
North: Washington Regional Medical Center, zoned A- I
South: Vacant land, zoned Gregory Park is directly south and zoned R- 1 .5
East: Quail Creek Subdivision, zoned R- 1
West: Apartments, zoned R-2
INFRASTRUCTURE:
Streets: Appleby Road is a two lane street and classified as a collector which is designed
to carry 4,000 to 6,000 vehicles per day.
Water: There is a 6" waterline to the east located within Quail Creek Subdivision and an
8" waterline to the west located within the apartment complex.
Sewer: There is a 16" sewer line to the west and a 6" sewer line to the south.
LAND USE PLAN:
The General Plan 2020 shows this area as Residential
§ 161.04 DISTRICT R-1: LOW DENSITY RESIDENTIAL.
A. Purpose. The Low Density Residential District is designed to permit and encourage
the development of low density detached dwellings in suitable environments, as well as to protect

FINDINGS OF THE STAFF
1 . A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The Land Use Plan (General Plan 2020) shows this area as residential. The
proposed zoning of R-1 (Low Density Residential) is consistent with the plan.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The proposed zoning to R-1 is justified and needed at this time.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: The proposed zoning R-1 would not create or appreciably increase traffic
danger and congestion in this area.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning to R-1 would not alter the population density and
thereby undesirably increase the load on public services including schools,
water, and sewer facilities. On-site and off-site improvements including
sewer will be required at the time of Large Scale Development or
Preliminary Plat approval.
5 . If there are reasons why the proposed zoning should not be approved in view of
considerations under b ( 1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning
even though there are reasons under b ( 1 ) through (4) above why
the proposed zoning is not desirable.
