The property is owned by John DeWeese, Mike Schmidt, and Karen Schmidt. The property is located west of Fayetteville and south on Double Springs Road between Fayetteville and Farmington. Approximately 200 feet of the subject property adjoins the Fayetteville City Limits. There is approximately 1300 feet of frontage along Double Springs Road. The property is approximately 1000 feet north of the Farmington City Limits. The rezoning is contingent upon the annexation of the 48 acres. ADJACENT LAND USE AND ZONING: North: Owl Creek, undeveloped property, and single family residences exist to the north. South: A subdivision of single family residences exist outside the Fayetteville City Limits and Farmington City Limits to the south. _ East: Single family residences exist outside the city limits. West: Single family and undeveloped land exist outside the city limits. INFRASTRUCTURE: Streets: Double Springs Road is a minor arterial with 90' of R.O.W. (45' from centerline) Water: There is a 4" waterline along the west side of Double Springs Road. Sewer: There is a 10" force main existing along Owl Creek northeast of the property. It ends at a lift station located approximately 1250' north of the property. LAND USE PLAN: The General Plan 2020 shows this area as Residential. A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: The Land Use Plan (General Plan 2020) shows this area as residential. The proposed zoning of R-1 (Single Family Residential) is consistent with the plan. 2. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: The proposed zoning R-1 is justified and needed at this time. 3. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: The proposed zoning would not create or appreciably increase traffic danger and congestion in this area. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. On-site and off-site improvements including sewer will be required at the time of Large Scale Development and Preliminary Plat approval. 5. It would be impractical to use the land for any of the uses permitted under its existing zoning classifications; b. There are extenuating circumstances which justify the rezoning even though there are reasons under b ( 1 ) through (4) above why the proposed zoning is not desirable. The property is in the planning growth area and contains approximately 47.98 acres. The request is to rezone from A- 1 , Agricultural to R-1 , Low Density Residential. Michele Harrington was present on behalf of the request. Staff recommends approval of the proposed R- 1 zoning based on the findings included in the staff report. Commission Discussion Johnson: This is related to RZA99-3 . This is a request to rezone from A- 1 , Agricultural to R- 1 , Low Density Residential. The staff has recommended this. The reason being, I take it, since the whole idea was to subdivide this tract and the City feels like it does better when a subdivision is on it's border that it be brought into the city so that the more stringent city requirements apply and the greater city services that are available. Tim, what do you have to add to your positive recommendation for this rezoning. Conklin: Once again, this is an opportunity to develop this land under our urban subdivision regulations. Once again, they get city services plus we get streets to city standards, street lights, and the other things that go along with those more stringent standards. We did recommend approval. Johnson: I don't recall that we've mentioned yet but I believe that at agenda session on Thursday, you told us that you had spoken with the City of Farmington and the City of Farmington has no opposition to this annexation coming into the City of Fayetteville. I should have brought that out on the previous vote. Conklin: I did speak with the City of Farmington. Actually, this developer did approach the City of Farmington about possibly being within their city. They were not contiguous with their city limits. They are contiguous with the city limit of Fayetteville. Therefore, they chose to come into Fayetteville. Public Comment None. Hoffman: I' ll second that with the same admonition about utility availability. Johnson: First, let me restate the motion which is for approval of this rezoning 99-27 moved by Conu issioner Shackelford and seconded by Commission Hoffman. Is there discussion? Hoffman: For the record, utility availability is a subject of concern. Roll Call Upon roll call, the motion passed with a unanimous vote of 9-0-0. Johnson: The motion carried with a vote of 9 to 0 so that we recommend the rezoning to the Council which has final say on rezonings as well. Meeting adjourned at 7: 18 p.m.
