HomeMy WebLinkAboutOrdinance 4136 ORDINANCE NO. 4136 AN ORDINANCE WAIVING THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING FOR THE PURCHASE OF USED/DEMONSTRATOR/RENTAL SELF POWERED WEDGE FOOT ROLLER TO BE UTILIZED BY THE STREET MAINTENANCE DIVISION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . The City Council hereby waives the requirements of formal competitive bidding for the purchase of Used/Demonstrator/Rental Self Powered Wedge Foot Roller which will be utilized by the Street Maintenance Division. Said formal bidding requirements would prevent purchase of such used units as dealers do not find it practical to hold used units for the time necessary to comply with those requirements. Therefore, with the time frame required, it would not be feasible or practical to take and award a formal competitive bid. Section 2. The total number of units involved in this purchase will not exceed 1 unit. v Section 3. The City Council hereby authorizes representatives of the Fleet Operations Division and the Street Maintenance Division to evaluate, compare and finalize a recommendation to the Equipment Committee upon unanimous approval to purchase an appropriate used/demonstrator/rental unit "on the spot' at a total cost not to exceed $40,000.00. Section 4. The City Council hereby authorizes the Equipment Committee to review the recommendation for final approval prior to submission to the Mayor. Section 5. The City Council hereby authorizes the Mayor to review the recommendations of the Equipment Committee prior to approving purchase. PASSED AND APPROVED this 2nd day of February 1999. A. 2 CM OF FAYMEWUX RERT O11`M&MdV` M-O C"H MEMORANDUM TO: Mayor/City Council THRU: Kevin Crosson, Administrative Services Director FROM: William Oestreich, Fleet Operations Superintendent DATE: January 12, 1999 SUBJECT: Bid Waiver for Used/Demonstrator Self Propelled Wedge foot Roller Attached is a proposed Ordinance providing for a Bid Waiver to purchase a used or demonstrator Self Propelled Wedge foot Roller to be utilized basically in the Street Maintenance Program. (Reference 1999 Budget-Project 98062) 1 have conducted an informal survey of several Arkansas and Oklahoma dealers and have found some used and rental units of various brands and sizes that could fit into the criteria of our requirements. Procurement of a used/demonstrator/rental unit will allow us to gain a much more desirable unit for the dollar amount expended. The intent will be to procure a unit with useable life on par with comparable new units for the dollars expended. Upon approval of a Bid Waiver, a selection committee consisting of myself, Randy Allen and Kevin Crosson, would do further investigation to locate and recommend the purchase of a suitable unit prior to submission to the Equipment Committee and Mayor Hanna. Even though the necessity of procurement is not an emergency, it would be to the benefit of the City to suspend the normal procedure to allow the passage of this ordinance at the earliest possible opportunity. This will allow us to get the benefit of the current market trends which should prove to be very beneficial. 1 BID WAIVER III. A. 3 ORDINANCE NO.
