The property is zoned A- 1 , Agricultural, and contains approximately 2. 83 acres. The request is to change the zoning to R- 1 , Low Density Residential. PLANNING COMMISSION ACTION: YES Required Approved Denied Date: December 14, 1998 Comments: CITY COUNCIL ACTION: YES Required Approved Denied Date: BACKGROUND : The applicant requests rezoning of the property at 3061 Valerie Drive from A- 1 to R- 1 . The applicant desires the change in zoning to meet minimum lot sizes in order to request a lot split and plans to build a house on the lot to be created. The applicant currently owns the property and resides in the house existing on the property. The proposed lot split of this property will be the last split allowable on this property because there have been two prior splits. The current lot size (in excess of two acres) was necessary in order to meet the requiremnets of the A- 1 zone of two acres per single family dwelling unit and because sewer had no been previously available in that area. The new residence would be a single family dwelling and would be 'consistent with other houses in the neighborhood. The applicant plans to reside in the new residence and sell the existing one. The terrain on the property is extremely hilly and rocky with much shrubby growth. Immature trees make up most of the vegetation. Erosion is evident through the proposed lot. The land slopes to the east and the surrounding lots are single family residential. ADJACENT LAND USE AND ZONING North: Single family residential, zoned A- 1 South: Single family residential, zoned A- 1 East: Single family residential, zoned A- 1 West: Single family residential, zoned R-0 INFRASTRUCTURE: Streets: Valerie Drive is considered a local street with a 60' R.O.W. Hillside Terrace, which runs along the west side of the property, is also a local street with a 60' R.O.W. Water: There is a 6" AC water main along the north and a 2" PVC water main along the west side of the property. Two fire hydrants exist near the west boundary of the property. Sewer: Sewer is available within 200' of the property's northwestern and southwestern corners. LAND USE PLAN: General Plan 2020 shows this area as Residential. § 161.04 DISTRICT R-1 : LOW DENSITY RESIDENTIAL. A. Purpose. The Low Density Residential District is designed to permit and encourage the development of low density detached dwellings in suitable environments, as well as to protect existing development of these types. A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: The rezoning proposed is consistent with the land use planning objectives, principles, and policies of the land use and zoning plans. 2. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: The zoning is justified and needed at this time to meet the goals of General Plan 2020 for infill development. 3. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: The proposed zoning would not create or appreciably increase traffic danger and congestion. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public .services including schools, water, and sewer facilities. If there are reasons why the proposed zoning should not be approved in view of considerations under b ( 1 ) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a.
