HomeMy WebLinkAboutOrdinance 4125 ORDINANCE NO, 412 5 AN ORDINANCE AMENDING CHAPTER 157, NOTIFICATION AND PUBLIC HEARINGS, OF THE CODE OF FAYETTEVILLE, TO ADD SECTION 157.08, FIRE PREVENTION CODE, REQUIRING NOTIFICATION TO RESIDENTIAL PROPERTY OWNERS WITHIN 200 YARDS OF A BLASTING SITE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That Chapter 157, Notification and Public Hearings, of the Code of Fayetteville is hereby amended to add the following: §157.08 FIRE PREVENTION CODE, Blasting. In addition to the requirements and regulations provided in the Fire Prevention Code, the applicant for a blasting permit shall notify all residential property owners located within 200 yards of a blasting site. Notification may be personal contact or by written notice left at the residence and shall contain the dates of any blasting activity. The code provides the minimum requirements necessary to maintain any residential occupancy in a safe and sanitary condition. The Standard Housing Code is one of the ten codes published and maintained by the Southern Building Code Congress International and is a minimum housing code relating principally to the use, occupancy and maintenance of existing residential buildings and shall not be construed as being a building construction code. The Standard Housing Code contains certain terminologies or references, such as "properly installed," "properly connected," ..properly constructed" and other similar terms. It is intended that these references relate to the Standard Building, Plumbing, Gas. Mechanical and other codes published by the Southern Building Code Congress International or any other codes officially adopted and administered by the governing body ol' this code. The appellant must state the variance or modification requested , the reasons therefor, and the hardship or conditions upon which the appeal is made. 108 VIOLATIONS AND PENALTIES Any person, firm, corporation or agent, who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, or who shall erect , construct, alter, demolish or move any structure. or has erected. constructed, altered, repaired, moved or demolished a building or structure in violation of this code shall be prosecuted within the limits provided by state or local laws. Each such person shall be ' deemed guilty of a separate . . offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, or continued and upon conviction of any such violation such person shall be punished within the limits and as provided by state laws.
