AN ORDINANCE WAIVING THE REQUIREMENTS OF
FORMAL COMPETITIVE BIDDING FOR THE PURCHASE OF
SPECIALIZED EQUIPMENT AND/OR SUPPLIES RELATING
TO THE GAS BOY FUEL DISPENSING, RECORDING, AND
CONTROL EQUIPMENT WHICH IS UTILIZED BY THE CITY
OF FAYETTEVILLE VEHICLE OPERATIONS PROGRAMS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . The City Council hereby waives the requirements of formal competitive
bidding for the purchase of specialized parts, accessories, related equipment, supplies, installation
maintenance, and repair of same which will be utilized in conjunction with existing GAS BOY fuel
dispensing, recording, and/or control equipment which is currently being used by the City of
Fayetteville as part of their fueling requirements for vehicles and/or equipment. Said requirements
do not take into consideration the factors of compatibility, standardization and maintainability
which must be followed. Only one manufacturer is capable of supplying said parts, etc. Therefore
it would not be feasible or practical to take and award a formal competitive bid.
Section2. Said bid waiver shall continue in effect, subject to any needed budget or
_ s . contract approval, until such time as the City of Fayetteville discontinues operation of the GAS
BOY Fueling Control System.
