AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING TO UPGRADE A RAILROAD
CROSSINGS ON CATO SPRINGS ROAD AND APPROVING A
COST SHARING AGREEMENT WITH ARKANSAS AND
MISSOURI RAILROAD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the City Council hereby waives the requirements of competitive
bidding for upgrading a railroad crossing on Cato Springs Road for the reason that said
requirements are neither practical nor feasible. Arkansas and Missouri Railroad is the title holder
of the subject railroad crossing and will be providing all labor, materials, and equipment.
Fayetteville's participation in the project is as outlined in the Cost Sharing Agreement.
Section 2. That the Mayor and City Clerk are hereby authorized to execute a Cost Share
Agreement with the Arkansas and Missouri Railroad for the upgrade to a railroad crossing on Cato
Springs Road. A copy of the Cost Share Agreement authorized for execution is attached hereto and
Exhibit "A" and made a part hereof.

Dear Brent,
This letter is written to serve as a cost sharing agreement between the City of Fayetteville and
Arkansas and Missouri Railroad for the upgrading of a railroad crossing within the City of
Fayetteville. All labor, material, and equipment will be furnished by Arkansas and Missouri
Railroad's contractor. The City of Fayetteville will cost share in your project in the amount of
$35,610.
The crossings to be upgraded are located on Cato Springs Road.
The City of Fayetteville will provide detour routing and signage for the above project. It is
understood that the contractor will perforin his work during a weekend for the project.
