ORDINANCE NO, 4 0 4 8
AN ORDINANCE ADDING AN EMERGENCY CLAUSE TO
THE ORDINANCE ALLOWING NON-COMPLAINT
VIOLATIONS OF §96.04(A) .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section1. That the City Council hereby determines that the immediate enforcement
by city police of the noise violations without the necessity of a complaint between the hours of
10:00 p. m. and 1 :00 a.m. is necessary for the city to protect residents currently disturbed by
noise disturbances to rest and retire without interruption by noise potentially harmful to their
health and well being, and to protect reasonable persons of normal sensitivity from annoyances
or disturbances. Therefore, an emergency is declared to exist and this ordinance being necessary
for the public health, safety and welfare shall be fully force and effect from and after its passage
and approval .
