AN ORDINANCE AMENDING CHAPTER 98: STREETS AND
SIDEWALKS , SUBSECTION (E) , SIDEWALKS, OF THE
CODE OF FAYETTEVILLE, TO TRANSFER THE
RESPONSIBILITY OF REPAIR AND REPLACEMENT OF
SIDEWALKS FROM THE PROPERTY OWNERS TO THE
CITY .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section1. That Chapter 98 : STREETS AND SIDEWALKS, Subsection (E) ,
Sidewalks, of the Code of Fayetteville, is hereby deleted and the following shall be inserted in
its stead:
§98 . 15(E) . Sidewalks .
( 1) Existing city sidewalks shall be repaired and replaced by the city , as
needed .
(2) In establishing priorities for sidewalk repair or replacement, factors
such as the condition of the sidewalk, the expected level of pedestrian traffic, and
the use of the sidewalk by school children will be considered.
