AN ORDINANCE AUTHORIZING EMINENT DOMAIN
PROCEEDINGS FOR THE CITY TO OBTAIN LAND FOR RIGHT
OF WAY PURPOSES, WATERLINE PERMANENT EASEMENT
PURPOSES AND TEMPORARY CONSTRUCTION EASEMENT
PURPOSES FROM LAND OWNED BY JERRY D. SWEETSER
AND SHARON J. SWEETSER LOCATED ON 24TH STREET.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the City Council authorizes and directs the city attorney of the City of
Fayetteville, Arkansas to initiate legal action in order to obtain fee simple title of property described
below for right of way purposes; a permanent easement for waterline purposes, and a temporary
construction easement on, over and across the property described below:
See Exhibit "A" attached hereto and made a part hereof.

PERMANENT EASEMENT DESCRIPTION:
A fifteen (15) foot wide permanent water/sewer easement of equal and uniform width
located along the West side of and running parallel with and contiguous to a portion of
the proposed (under City Project No. 96043) South and West right of way line of 24th
Street, said easement being more particularly described as follows: Beginning at a point
which is South 02 ° 58 ' 20" West 159.58 feet along the West line of the above described
property and South 87 ' 01 ' 40" East 168.86 feet from the Northwest corner of said SE'/4
of the NE'/4, said point being the centerline of this easement, said centerline being on the
South line of an existing platted ten ( 10) foot wide water line easement that generally
runs East and West, and 7.50 feet Southwesterly from the proposed West right of way
line of 24th Street; thence said centerline running with a curve to the right a distance of
266.37 feet, said curve running parallel with the proposed West right of way line of 24th
Street, having a radius of 238.98 feet, a chord length of 252.80 feet at a bearing of South
