AN ORDINANCE AMENDING CHAPTER 94: FIRE
PREVENTION, OF THE CODE OF FAYETTEVILLE,
DECLARING AN OFFICER OF THE FAYETTEVILLE FIRE
DEPARTMENT TO BE MUNICIPAL FIRE MARSHAL TO
CARRY OUT SUCH DUTIES AND RESPONSIBILITIES AS
SET FORTH IN A.C.A . § 14-53- 112.
WHEREAS, pursuant to A.C.A. § 14-53- 112 Municipal Fire Marshal who have met
the training standards set out in that section are authorized and empowered to carry a weapon
and to make arrests for violations of the laws relating to arson and other unlawful burning; and,
WHEREAS, in order to meet the definition of Municipal Fire Marshal in A . C.A . § 14-
53- 112, an officer must hold a full time office or position of Fire Marshal created by ordinance
in a city of the first class; and,
WHEREAS, it is the desire of the City Council of the City of Fayetteville to exercise
the authority of A.C.A. § 14-53- 112;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . The position currently designated in the Fayetteville Fire Department as
"Fire Marshal" is hereby declared to be the office or position of Fire Marshal created by this
Ordinance.
Section 2 . In order to exercise the authority set forth in A. C.A . § 14-53- 112, the
person serving as Fire Marshal in and for the City of Fayetteville, Arkansas shall be required
to meet all requirements and prerequisites set forth in A.C.A. § 14-53-112 as well as complying
with all rules and regulations promulgated by the Fayetteville Fire Department.
Section 3 . Nothing in this Ordinance shall confer any additional benefit to, impose
any additional duty upon or otherwise affect the current position of Fire Marshal in the
Fayetteville Fire Department, it being the sole purpose of the City Council in adopting this
Ordinance to allow the person holding such position to exercise the authority of A . C.A. § 14-
