HomeMy WebLinkAboutOrdinance 3975 ORDINANCE NO. 3975 AN ORDINANCE WAIVING THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING FOR THE RENTAL/LEASING OF MISCELLANEOUS OPERATING EQUIPMENT FOR UTILIZATION AT THE CITY OF FAYETTEVILLE RECYCLABLE MATERIALS PROCESSING FACILITY LOCATED AT 1560 SOUTH HAPPY HOLLOW ROAD; AND APPROVAL OF A BUDGET ADJUSTMENT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That the City Council hereby waives the requirements of formal competitive bidding for the rental/leasing of miscellaneous equipment consisting of a fork lift with a bale handler, a skid steer loader, and/or equipment which can be utilized in the capacity of the units listed above. As the operation of the Recyclable materials Processing Facility will be a unique operation for the City of Fayetteville, said bid requirements for rental/leasing would limit the ability to locate and operate specialized equipment which could prove to increase productivity and efficiency of the operation. As rental/leasing will give the City the flexibility to operate various pieces of equipment in the environment that they will ultimately be kept in, and to modify usage requirements which may vary the type/style of equipment obtained, said bid requirement should prevent the flexibility needed to change equipment in the time frame necessary to maintain a proper operational level. As dealers do not find it practical to allow demonstrations of a length of time required for a proper evaluation, or to schedule such demonstrations in a manner to provide full time coverage of the needs of the City, it would not be feasible or practical to take and award formal competitive bids. Section 2. The City Council hereby authorizes representatives of the Solid Waste Division and the Fleet Operations Division to locate and obtain said equipment and to negotiate a rental/lease agreement which will allow sufficient time to properly evaluate said equipment and to properly maintain an acceptable operational level of the facility. Section 3 . Details of the rental/lease agreement for reach piece of equipment will be processed through normal contract channels prior to finalization of the rental/lease agreement. Section 4. Termination of the rental/lease agreements shall be at the discretion of the City of Fayetteville. Section 5 . The maximum dollar amount to be expended for said rental/lease is not to exceed $20,000. Section . The City Council hereby approves a budget adjustment in the amount of $20,000 increasing Equipment Rental, Acct. No. 9700 1910 5308 03 by decreasing Vehicles & Equipment, Acct. No. 9700 1920 5802 00, Project No. 95061 .
