HomeMy WebLinkAboutOrdinance 3970 ORDINANCE NO. 3 97 0 AN ORDINANCE AMENDING CHAPTER 160: ZONING, OF THE CODE OF FAYETTEVILLE, TO AMEND SUBCHAPTER: GENERAL PROVISIONS, SECTION 160.002 : DEFINITIONS, TO ADD A DEFINITION OF GARAGE SALES; TO AMEND SUBCHAPTER: USE CONDITIONS, SECTION 160.075 : LISTING, TO ADD GARAGE SALES; AND ADD SECTION 160. 103 : GARAGE SALES-CONDITIONS, TO PROVIDE CERTAIN CONDITIONS FOR CONDUCTING GARAGE SALES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That Chapter 160: Zoning, Subchapter: General Provisions, § 160.002 Definitions, of the Code of Fayetteville, is hereby amended to add the following: GARAGE SALES. An occasional sales activity, not to include activities described elsewhere as home occupations, but including activities generally referred to as garage sales, yard sales, rummage sales, white elephant sales, cleaning sales, or moving sales, where used goods are displayed or offered for sale to the general public in a residential area on the resident's premises. Section 2. That Chapter 160: Zoning, Subchapter: Use Conditions, § 160.075 : Listing, of the Code of Fayetteville is hereby amended to add: Garage sales. Section 3 . That Chapter 160, Zoning of the Code of Fayetteville, is hereby amended to add § 160. 103 , as follows: § 160. 103 Garage Sales. Garage Sales are permitted in any zoning district subject to the following conditions: (A) Frequency. Garage sales shall not locate in one location more than four times per year. (B) Term. Garage sales may be held for a duration not to exceed three consecutive days. (C) Signs. One on-site and three off-site temporary signs are allowed to be posted, however, posting may not occur more than two days before the sale begins. Signs are not to be located in public rights-of-way. Each sign shall not exceed 4.5 square feet in area. The off-site signs shall include address and date(s) of sale. All signs shall be removed by 8 :00 a.m. on the day following the sale. Page 2 Ordinance No. .3 9 70 Any such signs not so removed the following day or located in public rights-of- way may be removed by city staff and for any such sign removed, a collection fee of up to $25 .00 per sign shall he imposed.
