AN ORDINANCE AMENDING CHAPTER 160, ZONING, OF
THE CODE OF THE FAYETTEVILLE, TO REPEAL
§ 160. 117(H)( 1 )(b), WHICH PROVIDES FOR CERTAIN
PARKING WAIVERS ; TO ADD § 160. 117(H)( 1 )(b) TO
PROVIDE FOR SHARED PARKING; TO REPEAL
§ 160. 117(D)( 1 ) , OFF-STREET PARKING; TO ADD
§ 160.0117(D)( 1 ) TO EXCLUDE EXISTING STRUCTURES
WITH CHANGE OF USE IN C-3 AND C-4 ZONING
DISTRICTS FROM PARKING REGULATIONS; AND TO
ADD § 160. 117(D)(1 )(a), REQUIRING PARKING FOR NEW
CONSTRUCTION, RAZED BUILDINGS, AND ENLARGED
BUILDINGS IN C-3 AND C-4 ZONING DISTRICTS .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the Chapter 160, Zoning, § 160. 117(H)( 1 )(b), of the Code of the
Fayetteville, is hereby repealed and the following inserted in its stead:
§ 160. 117(H)( 1 )(b).
For any parking space which is proposed to be shared under the
provisions of § 160. 117(E)(4), the applicant must present a signed agreement
with the owner of the property . The agreement shall address the number of
spaces required by ordinance for both properties, the number of spaces available
together with a site plan, and any other pertinent information, such as
restrictions on sharing for certain days or hours.
Section 2 . That Chapter 160, Zoning, § 160. 117(D)(1 ), of the Code of Fayetteville,
is hereby repealed and the following inserted in it stead:
§ 160. 117(D) . Standards for the Number of Spaces, By Use.
1 . Off-Street Parking. Except as provided in (a) and (b) below, off-
street parking spaces shall conform to the requirement in Table 3 below.
Parking requirements shall be met at the time any building or structure is
erected, enlarged, or increased in capacity, changed in use, or any outdoor use
is established or enlarged.
a) In C-3 and C-4 Zoning Districts, parking requirements are
waived for any existing structure with a change of use. New construction, razed
buildings or enlarged buildings shall conform to the parking requirements of the
City of Fayetteville. For enlarged buildings, additional parking spaces will be
calculated by the amount of square footage that is added.

b) in C-3 and C-4, Zoning Districts, parking requirements are
waived for the square footage "footprint" of any building which existed and has
been removed since October 1 , 1995 , in order to rebuild.
