AN ORDINANCE REZONING THAT PROPERTY DESCRIBED
IN REZONING PETITION RZ96- 1 FOR A PARCEL
CONTAINING APPROXIMATELY 3 ACRES LOCATED WEST
OF 71 BYPASS, SOUTH OF MOORE LANE, SUBMITTED BY
GARY STEARMAN .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS :
Section 1 . That the zone classification of the following described property is hereby
changed as follows:
RZ96- 1 for the real property described in Exhibit "A" attached hereto and made
a part hereof.
From R-2, Medium Density Residential, to C-2, Thoroughfare Commercial .
Section 2. That the official zoning map of the City of Fayetteville, Arkansas, is
hereby amended to reflect the zoning change provided in Section 1 above.

BILL OF ASSURANCE
This declaration of a Bill of Assurance made this _SL day of
1996, by the undersigned, owner of the real estate more particularly described on Exhibit "A"
attached hereto and made a part hereof.
WHEREAS, the aforesaid owner of the aforedescribed real property has agreed to comply
with the requirements of Section 160.048 - Design Overlay District (U.S. 71 Highway Corridor)
for said real property; and,
WHEREAS, the owner is desirous of making a declaration of the same in the form of this
Bill of Assurance with the intention of guaranteeing the preservation of certain values and
amenities in the community and to bind the owner and the owner's successors and assigns and
the real estate described in Exhibit "A" and its subsequent owners with the obligations and
retribution hereinafter set forth for all present and future development and use of said property.
NOW, THEREFORE, the owner declares that the above described real property shall be
held, developed, transferred, old, conveyed and occupied subject to restrictions set forth under
Section 160.048 - Design Overlay District (U.S. 71 Highway Corridor.)
