HomeMy WebLinkAboutOrdinance 3947 ORDINANCE NO. 3947 AN ORDINANCE AMENDING CHAPTER 161 : PHYShMAE- ALTERATION OF LAND, OF THE CODE OF FAYETTEVIII TO ADD SECTION 161 .04(F) SETTING FORTH STANDARDS FOR CLEAN-UP OF DEBRIS, SOIL OR MUD FROM DEVELOPMENT SITES TRANSPORTED ONTO PUBLIC STREETS . WHEREAS, the City Council wishes to minimize the hazards related to debris, soil or mud being transported onto public streets; and, WHEREAS, the City Council wishes to reduce the amount of debris, soil or mud from development sites that is transported onto public streets in order to minimize the amount of debris, soil or mud that flows into the storm water system and eventually into our streams, rivers and lakes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That Chapter 161 : Physical Alteration of Land, § 161 .04, Minimal Erosion Control Requirements, of the Code of Fayetteville is hereby amended to add § 161 .04(F) as follows: § 161 .04 Minimal Erosion Control Requirements. (F) Any debris, soil or mud from developments sites reaching a public street shall be immediately removed. Failure to immediately remove debris, soil or mud from a public street may result in the issuance of a stop work order by the Mayor or his/her designated representative. The stop work order shall remain in full force and effect until the street is restored and adequate measures are in place to insure that the streets will remain clear. Failure to immediately remove debris, soil or mud from public streets may result in the City performing such clean-up operations. In this event all costs, including labor, equipment, and materials, shall be billed to the property owner who is subject to the requirements of Chapter 161 : Physical Alteration of Land.
