AN ORDINANCE TO ESTABLISH AND LAYi '� OF '
FAYETTEVILLE MUNICIPAL PROPERTY OWNERS'
IMPROVEMENT DISTRICT NO. 2 - ZION Vai_I_FV
ESTATES PROJECT.
WHEREAS, a Petition to form Fayetteville Municipal Property Owners' Improvement
District No. 2 - Zion Valley Estates Project has been with the Fayetteville City Clerk; and,
WHEREAS, notice of the filing of the petition for creation of such district has been
given by fust class mail to the Mayor by the City Clerk; and,
WHEREAS, the City Clerk has presented said petition to the Mayor; and,
WHEREAS, the Mayor has set December 18, 1995 , at the date and time for a hearing
before the Fayetteville City Council for consideration of said petition; and,
WHEREAS, the Fayetteville City Council has determined from an abstractor's
certificate of property ownership that those signing said petition constitute all the owners of the
real property to be located in said district; and,
WHEREAS, the Arkansas Municipal Property Owners' Improvement District Law
provides that if the governing body determines that all the owners of the real property to be
located in the district have petitioned for the improvements, it shall then be its duty by
ordinance to establish and lay off the district as defined in the petition and to appoint the
commissioners named in the petition.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS :
Section 1 . That the real property described in Exhibit "A" attached hereto and made
a part hereof is hereby established and laid off as Fayetteville Municipal Property Owners'
Improvement District No. 2 - Zion Valley Estates Project for the purpose of constructing and
installing facilities for waterworks, recreation, drainage, gas pipelines, underground trenches
and excavation necessary for the installation of electric and telephone distribution systems,
sanitary sewers, streets including curbs and gutters and sidewalks, together with facilities
related to any of the foregoing within said district.
Section 2. The following three individuals are hereby appointed as commissioners
of said improvement district: S.J. "Jack" Torre, Robert B. Leflar, and William Mason.
Section 3 . The name of said improvement district shall be Fayetteville Municipal
Property Owners' Improvement District No. 2 - Zion Valley Estates Project.

Section 4. The Fayetteville City Council hereby determines that there is a need for
additional infrastructure within the City and hereby determines that the passage of this
ordinance will facilitate construction of additional infrastructure within the City. Therefore,
an emergency is hereby declared to exist, and this ordinance being necessary for the public
health, safety and welfare shall be in full force and effect from and after its passage and
approval.

Robert B Leflar and S. I Torre, Members of Zion Valley, L.L.C., owner of the following
described real property situated in the City of Fayetteville, Washington County, Arkansas,
to-wit:
Tract A: Part of the Southwest Quarter of the Southwest Quarter of
Section 24, T-17N, R-30W, and being more particularly described as follows,
to-wit: Beginning at the South East corner of said 40 acre tract, and running
thence N 86-47-23 W 328.74 feet, thence N 02-40-27 E 1327. 10 feet, thence
S 87-21-31 E 327.92 feet; thence S 02-39-22 W 899.33 feet, thence S 02-36-17
W 430.63 feet to the point of beginning, containing 10.02 acres, more or less.
Also, part of the Northwest Quarter of the Southwest Quarter of Section 24,
T-17N, R-30W, and being more particularly described as follows, to-wit:
Commencing at the South East corner of said 40 acre tract, and running

WHEREAS, the aforesaid owner of the real property described above has secured
the approval of the Fayetteville City Planning Commission and is seeking the approval of
the Fayetteville, City Council to change the zoning of the above-described 27.72 acre tract
(thus amending the Fayetteville zoning map) from A-1 to R-2; and,
WHEREAS, the owner has offered and agreed to limit the number of units to no
more than one hundred four ( 104); and,

WHEREAS, the owner is hereby making a declaration in the form of this Bill of
Assurance with the intention of guaranteeing the preservation of certain values and integrity
in the neighborhood and community, and to bind itself, its successors and assigns and the
aforedescribed real property and its subsequent owners with the obligation and restrictions
hereinafter set forth for all present and future development and use of said property.
NOW, THEREFORE, the owner declares that the above-described property shall
be held, developed, transferred, sold, conveyed and occupied subject to the above-
declaration and covenant of restrictions, by his signature below.
