ORDINANCE NO. 3938
AN ORDINANCE PRESCRIBING CONNECTION FEES FOR
DEVELOPERS TYING ONTO A WATER LINE EXTENSION
ALONG SALEM ROAD RUNNING FROM THE SOUTHEAST
CORNER OF THE SALEM VILLAGE SUBDIVISION TO THE
SOUTH SIDE OF MOUNT COMFORT ROAD.
WHEREAS, the City of Fayetteville is sharing in the cost of a new water line on Salem
Road; and,
WHEREAS, it is the desire of the City to insure that developers utilizing said water line
pay a fair share of the cost of that line.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS :
Section 1 . That Chapter 51 , Section 51 . 115 , Water, Sewer Extension Fees, of the
Code of Fayetteville is hereby amended by adding Paragraph "F" to read as follows:
§51 . 115 Water, Sewer Extension Fees.
F. Salem Road. If a developer connects directly to the water line
extension along Salem Road running from the Southeast corner of Salem Village
Subdivision to the South side of Mount Comfort Road, more clearly shown on
Exhibit "A " , attached hereto and made a part hereof, within a ten (10) year
period from the date of the passage of this ordinance, the developer shall pay an
extension fee of $200.00 per gross acre of land being developed.
In no case shall the amount collected under this ordinance exceed the
actual cost of the construction of the extension. Such construction costs to
include the installation, engineering, and right of way acquisition.
All monies received from the extension fee imposed above, (plus interest,
if any), shall be deposited in a water and sewer fund and shall be expended from
that fund only for the purposes of making emergency repairs and extending,
oversizing, or constructing new additions to the City's water system.
