AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING FOR THE EXTENSION OF A
WATER LINE ON SALEM ROAD IN CONJUNCTION WITH
THE DEVELOPER OF SALEM VILLAGE SUBDIVISION
AND APPROVING A LETTER AGREEMENT WITH
TRADITIONAL INVESTMENTS LIMITED PARTNERSHIP.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council hereby waives the requirements of competitive
bidding for the extension of a water line on Salem Road in conjunction with the developer of
Salem Village Subdivision for the reason that said requirements are neither practical nor
feasible. Traditional Investments Limited Partnership is the "developer" of Salem Village
Subdivision and has contracted for certain engineering services and construction of water lines.
The subject project is an extension to the above water line and the developer will provide the
engineering and construction of the extension. Fayetteville's participation in the project is as
outlined in the Cost Sharing Agreement.
Section 2. That the Mayor and City Clerk are hereby authorized to execute a Letter
Agreement for the Water Line Extension/Salem Village Subdivision with Traditional
Investments Limited Partnership. A copy of the Letter Agreement authorized for execution is
attached hereto as Exhibit "A" and made a part hereof.

Attached for the Mayor ' s signature are two ( 2 ) originals of
the letter agreement as noted above . Please forward them to the
Mayor for his signature . The Council has already approved the
letter agreement and should approve a connection fee at the next
Council Meeting .
One original needs to go back to Traditional Investments and
one should go to the City Clerk . I have made a copy for our files .

Salem Village Subdivision
Gentlemen ,
This will serve as a letter agreement between the City of
Fayetteville and Traditional Investments Limited Partnership
( Developer ) to provide for cost sharing the extension of an 8 -Inch
water line from the southeast corner of the Salem Village
Subdivision along the west side of Salem Road to the south side of
Mount Comfort Road ,
The Developer agrees to be responsible for the engineering and
construction of approximately 2600 feet of the 811 water line with
the necessary valves , fire hydrants , and including the tie- in to
the 12 11 line on the south side of Mt . Comfort Road , The City of
Fayetteville agrees to :
1 . Reimburse the Developer for the south 1500 feet of
line , including the crossing of Mt . Comfort Road and the
tie- in to the existing 1211 water line ,
2 . Reimburse the Developer for the cost of engineering
for the entire line from the southeast corner of the
subdivision south to the tie- in south of Mt . Comfort
Road ,
3 . Reimburse the developer for the cost of installing any
fire hydrants along the 811 line that are deemed necessary
by the City ,
4 . Be responsible for the acquisition of any easements
required for the extension .

The intent of this agreement that the Developer ' s share of the
cost be restricted to the installation of approximately 1100 feet
of water line which is the length of the alternate tie- in to the
north .
Please indicate your acceptance of the terms of this letter
agreement by signing in the appropriate location below . The Mayor
will sign the agreement once it is approved by the City Council .
