AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING FOR UPGRADES TO CONCRETE
RAILROAD CROSSINGS ON BEECHWOOD AVENUE AND
POPLAR STREET AND APPROVING A COST SHARING
AGREEMENT WITH ARKANSAS AND MISSOURI
RAILROAD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council hereby waives the requirements of competitive
bidding for upgrades to concrete railroad crossing on Beechwood Avenue and Poplar Street for
the reason that said requirements are neither practical nor feasible. Arkansas and Missouri
Railroad is the title holder of the subject railroad crossings and will be providing all labor,
materials, and equipment. Fayetteville's participation in the project is as outlined in the Cost
Sharing Agreement.
Section 2 . That the Mayor and City Clerk are hereby authorized to execute a Cost
Share Agreement with the Arkansas and Missouri Railroad for the upgrades to concrete railroad
crossings on Beechwood Avenue and Poplar Street. A copy of the Cost Share Agreement
authorized for execution is attached hereto as Exhibit "A " and made a part hereof.

Dear Brent ,
This letter is written to serve as a cost sharing agreement between
the City of Fayetteville and Arkansas and Missouri Railroad for the
upgrading of railroad crossings within the City of Fayetteville .
All labor , materials , and equipment will be furnished by Arkansas
and Missouri Railroad ' s contractor . The City of Fayetteville will
cost share in your project in the amount of $ 17 , 941 . 40 .
The crossings to be upgraded are located on Beechwood Avenue and
Poplar Street .
Arkansas and Missouri Railroad is committing to the upgrade on
Beechwood Avenue and is hoping to have the available funds to
upgrade the crossing on Poplar Street also . However , if they do not
have the funding available to do both crossing upgrades , then the
City of Fayetteville ' s cost-sharing amount will be reduced to
$ 8 , 191 . 40 .
The City of Fayetteville will provide detour routing and signage
for all of the above projects . It is understood that the contractor
will perform his work during weekends for each project .
