AN ORDINANCE AMENDING CHAPTER 162 : TREE
PROTECTION AND PRESERVATION , OF THE CODE OF
FAYETTEVILLE, TO REMOVE ALL REFERENCES TO
PLANNING MANAGEMENT DIRECTOR AND INSERTING
THE TITLE OF LANDSCAPE ADMINISTRATOR IN ITS
STEAD; FURTHER, SECTION 162 .02 DEFINITIONS, OF
THE CODE OF FAYETTEVILLE, SHALL BE AMENDED TO
REPEAL THE DEFINITION OF PLANNING MANAGEMENT
DIRECTOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That Chapter 162 : Tree Protection and Preservation, of the Code of
Fayetteville is hereby amended to remove all references to Planning Management Director and
inserting the title of Landscape Administrator in its stead.
Section 2. That Section 162 .02 Definitions, of the Code of Fayetteville, is hereby
amended to repeal the definition of Planning Management Director.
Section 3 . That the City Council hereby determines that the protection and
preservation of trees and the efficient and prompt administration of the Tree Protection and
Preservation Ordinance is needed due to the rapid growth of Fayetteville and accordingly unless
put into effect immediately, the public health, safety, and welfare of the people of Fayetteville
will be adversely affected. Therefore, an emergency is hereby declared to exist and this
ordinance being necessary for the public health, safety, and welfare shall be in full force and
effect from and after its passage and approval.
