ORDINANCE NO. 3881 -
AN ORDINANCE VACATING AND ABANDONING TWO
SEWER EASEMENTS LOCATED ON PROPERTY
DESCRIBED AS 244 E . ROCK STREET .
WHEREAS, the City Council has the authority under A.C .A. § 14-54- 104 to vacate
public grounds or portions thereof as may not for the time being be required for corporate
purposes; and
WHEREAS, the City Council has determined that the following described utility
easements are not required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS :
Section 1 . That the City of Fayetteville, Arkansas hereby vacates and abandons all
of its rights together with the rights of the public generally, in and to the following described
sewer easements :
See Exhibit "A" attached hereto and made a part hereof.
Section 2. That a copy of this Ordinance duly certified by the City Clerk shall be
filed in the office of the Recorder of the County and recorded in the Deed Records of the
County .

A part of Lots numbered 8 , 9, 10, 11 , 12, 13 and 14 in Block Number 2 of the
Hicks Addition to the City of Fayetteville, Arkansas, as described in a Warranty
Deed recorded in Book 94 at Page 26793 in the office of the Circuit Clerk and
Ex-Officio Recorder of Washington County, Arkansas, and more particularly
described as follows, to-wit:
(I) . Ten feet either side of a line described as : Beginning at a point which is
South 72 degrees, 49 minutes, 29 seconds West, 88 .64 feet from the Northeast
corner of the above described tract, thence South 08 degrees, 31 minutes, 09
seconds West, 257.47 feet to a sanitary sewer manhole on the existing City
street Right-of-Way.
(II) . Ten feet from either side of a line described as follows: Beginning at a point
which is North 88 degrees, 58 minutes, 21 seconds East, 92.0 feet from the Southwest
corner of the above described tract, thence North 23 degrees, 15 minutes East to its
convergence with a Right-of-Way grant described in an instrument recorded in Book
1373 at Page 521 in the office of the Circuit Clerk and Ex-Officio Recorder of
Washington County , Arkansas.
