AN ORDINANCE WAIVING THE REQUIREMENTS OF
FORMAL COMPETITIVE BIDDING FOR THE PURCHASE
OF A USED 5100ZL PERKIN ELMER ATOMIC
ABSORPTION SPECTROPHOTOMETER FOR USE IN THE
WASTE WATER TREATMENT PLANT'S LABORATORY .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . The City Council hereby waives the requirements of formal competitive
bidding for the purchase of a used 5100ZL Perkin Elmer Atomic Absorption Spectrophotometer
for the in the Waste Water Treatment Plant's laboratory for the reason that said requirements
are neither practical nor feasible as dealers will not hold used equipment for the time necessary
to take and award formal competitive bids.
Section 2. The City Council hereby authorizes a representative of the Fayetteville
Wastewater Treatment Facility to approve purchase of the above described equipment at a total
cost not to exceed $40,000.00.
Section 3 . The total number of equipment involved in this purchase will not exceed
one unit.
Section 4. This bid waiver will expire on January 15, 1995 .
Section 5 . The City Council hereby determines that the aforesaid provisions are
necessary and unless put into effect immediately, the public health, safety, and welfare of the
people of Fayetteville will be adversely affected. Therefore, an emergency is hereby declared
to exist and this ordinance being necessary for the public health , safety, and welfare shall be
in full force and effect from and after its passage and approval.
