Home My WebLink AboutOrdinance 3842 ORDINANCE NO. 3842 AN ORDINANCE AMENDING CHAPTER 50, GARBAGE AND TRASH, OF THE CODE OF FAYETTEVILLE, TO IMPLEMENT A SOLID WASTE OPERATIONS UPDATE: TO AMEND DEFINITIONS; TO ELIMINATE THE REFERENCE TO CANS IN THE COLLECTION OF COMMERCIAL ACCOUNTS; TO PROVIDE FOR CONTAINER RENTAL TO COMMERCIAL ACCOUNTS ; TO PROVIDE FOR A COMMERCIAL SERVICE UPGRADE; AND TO PROVIDE FOR EXTRA SERVICES . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That Chapter 50, Garbage and Trash, Section 50.01 , Definitions, of the Code of Fayetteville, is hereby amended as follows: A . The definition for commercial services shall be repealed and the following shall be inserted : §50.01 Definitions. COMMERCIAL SERVICE- The collection and removal of garbage and trash from any other establishment other than single family residents. Commercial service shall include, but not be limited to : office buildings, private institutions, professional buildings, restaurants, apartments, duplexes and trailer parks . B. The definition for residential service shall be repealed and the following shall be inserted: §50.01 Definitions. RESIDENTIAL SERVICE- The collection and removal of garbage and trash from all single family residents located on public roadways within the City of Fayetteville. Collection of garbage and trash from residents on private roadways will be at the discretion of the City . Section 2. A. That Chapter 50, Garbage and Trash, Section 50.20, Container-Receptacle Specifications, of the Code of Fayetteville, shall be amended to add: Page 2 Ordinance No. 3842 November 16, 1994 §50.20 Container, Receptacle Specifications. (G) All commercial waste shall be placed in containers. Such containers shall meet specifications set forth by the Public Works Director, and shall be compatible for automated commercial collection by city vehicles . Containers of volume less than two (2) cubic yards shall be issued through the City solid waste division for a purchase price or container cost plus taxes and delivery charges. B. That Chapter 50, Garbage and Trash, of the Code of Fayetteville shall be amended to delete any and all references to cans, trash cans, or garbage cans when used in regard to commercial service. Section 3 . A . That Chapter 50, Garbage and Trash, Section 50.40, Rates for Services, (B) Commercial Service, (1 ) and (3) of the Code of Fayetteville shall be repealed and the following shall be inserted: §50.40 RATES FOR SERVICES (B) Commercial Service. (1 ) The minimum monthly commercial rate shall be $ 10. 17 per month for one container for each commercial establishment. (3) Commercial accounts shall be serviced once per week, Monday through Friday, excepting authorized holidays for city employees. (4) The rate for providing extra collection of any commercial container shall be $6\per cubic yard per pickup for loose trash and $15\per cubic yard per pick up for compacted trash.
