AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING FOR DEMOLITION OF THE EAST
PORTION OF THE OZARK THEATER; AND APPROVAL OF
A BUDGET ADJUSTMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . The City Council hereby waives the requirements of competitive bidding
for the demolition of the east portion of the Ozark Theater for the requirements are neither
practical nor feasible. The property was given to the City by the Resolution Trust Corporation
on the condition that the City remove the hazards associated with the building by a time certain.
Subsequently, the City and the Downtown Parking District entered into negotiation for the
conveyance of the property. Recently the City was informed that the Downtown Parking District
was no longer interested in the property . To meet the contract provisions with Resolution Trust
Corporation, action must begin promptly to remove the hazards.
Section 2 . The City Council hereby approves a budget adjustment increasing Contract
Services, Account No. 1010 6600 5315 00 in the amount of $20,000.00 and decreasing Use of
Fund Balance, Account No. 1010 0001 4999 99 in the amount of $20,000.00. A copy of the
budget adjustment is attached hereto and made a hereof.
Section . The City Council hereby determines that immediate action to remove the
hazards associated with the Ozark Theater Building is necessary to protect the public health,
safety and welfare. Therefore, an emergency is hereby declared to exist and this ordinance being
necessary for the public health, safety and welfare shall be in full force and effect from and after
its passage and approval.
