ORDINANCE NO. 3818
AN ORDINANCE DEFINING GRAFFITI , MAKING ITS
APPLICATION UNLAWFUL AND FIXING THE
PUNISHMENT FOR ITS APPLICATION .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS :
Section 1 . DEFINITION . Graffiti, for purposes of this ordinance, the term
"graffiti " shall mean any inscription, word, figure, design, symbol or insignia which is marked,
etched, scratched, drawn, painted or otherwise affixed to or placed upon public or private
property located within the City of Fayetteville to the extent that the same was not authorized
in advance by the owner.
Section 2. UNLAWFUL TO APPLY GRAFFITI . It shall be unlawful for any
person to apply graffiti upon any public and privately owned structure located on public or
privately owned real property within the City, and any person who is found guilty of affixing
graffiti to private or public property shall be punished by a fine of not more than $500.00, or
by imprisonment for not more than 90 days, or by both such fines and imprisonment. Nothing
contained herein shall prevent the City of Fayetteville from pursuing any other remedy available
for redress of any damage or injury caused by the action of any such person.
