HomeMy WebLinkAboutOrdinance 3804 ORDINANCE NO. 3804 AN ORDINANCE LEVYING THE FRANCHISE TAX PAYABLE BY THE CITY OF FAYETTEVILLE WATER AND SEWER FUND AND BY THE CITY OF FAYETTEVILLE SOLID WASTE FUND; AND RESCINDING ALL PREVIOUS ORDINANCES LEVYING A FRANCHISE TAX PAYABLE BY THE CITY OF FAYETTEVILLE WATER AND SEWER FUND AND BY THE CITY OF FAYETTEVILLE SOLID WASTE FUND ; AND APPROVING A BUDGET ADJUSTMENT IN THE AMOUNT OF $1 ,6579000.00. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That the Water and Sewer Fund shall pay to the City of Fayetteville General Fund 3 % of annual total gross water sales revenues for the privilege of operating a water transmission system within the street, avenues, alleys, roads, and highways, and the public places in the City of Fayetteville. Section 2. That the Water and Sewer Fund shall pay to the City of Fayetteville General Fund 3 % of annual total gross sewer charges revenues for the privilege of operating a sewer collection system within the street, avenues, alleys, roads, and highways, and the public places in the City of Fayetteville. Section 3 . That the Solid Waste Fund shall pay to the City of Fayetteville General Fund 3 % of annual total gross sanitation fee revenues for the privilege of operating a solid waste collection system within the street, avenues, alleys, roads, and highways, and the public places in the City of Fayetteville. Section 4. That the franchise tax shall be based on the prior calendar year's revenues as set forth above. Section 5 . That all previous ordinances and specifically Ordinance No. 3518 which levy or purport to levy a franchise tax payable by the City of Fayetteville Water and Sewer Fund and/or the City of Fayetteville Solid Waste Fund are hereby rescinded and repealed. Section 6. The City Council hereby approves a budget adjustment increasing the Water and Sewer Fund, Acct. No. 1010 6600 7602.40 in the amount of $1 ,657,000.00 by decreasing the Use of Fund Balance, Acct. No. 1010 0001 4999 99.
