Home My WebLink AboutOrdinance 3781 ORDINANCE NO. 3781 AN ORDINANCE AMENDING CHAPTER 159: SUBDIVISION REGULATIONS; § 159. 12(C) TO ALLOW FOURTEEN ( 14) DAYS FOR THE APPEAL OF THE DECISION OF THE PLANNING COMMISSION REGARDING PRELIMINARY PLATS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That Chapter 159 : Subdivisions Regulations, § 159. 12(C) is hereby repealed and the following is substituted in its place: § 159. 12(C) Planning Commission Action. The Planning Commission shall consider the preliminary plat along with all reports and comments by utility companies, city departments and others. Within thirty (30) days after the Planning Administrator's receipt of the preliminary plat, the Planning Commission shall indicate its approval, disapproval or approval with conditions. Any member of the City Council may appeal the decision of the Planning Commission to the City Council by filing written notice of appeal with the City Clerk within fourteen ( 14) days of the Planning Commission's decision. The notice of appeal shall specifically state the reasons the appellant contends the Planning Commission's decision was in error. A majority vote of the City Council shall be required for the appeal to be heard. The City Council shall hear all persons desiring to be heard on the question of whether the decision of the Planning Commission was in error. Following such hearing, the City Council may affirm, modify, or reverse the decision of the Planning Commission or may refer the proposed preliminary plat back to the Planning Commission for additional findings.
