AN ORDINANCE AMENDING SECTION 34.23 OF THE
FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THE
MAYOR AUTHORITY TO APPROVE CONTRACT CHANGE
ORDERS UP TO THE CONTINGENCY AMOUNT APPROVED
BY THE CITY COUNCIL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS :
Section 1 . That §34.23, Purchases and Contracts Not in Excess of $20,000, of the
Fayetteville Code of Ordinances, shall be amended to include the following inserted as the last
sentence:
The Mayor shall have the authority to approve contract change orders up to the
contingency amount, if any, as set forth in any approved contract even though
such contingency amount may exceed $20,000.
Section 2. The City Council hereby determines that the authority of the Mayor to
approve contract change orders up to the contingency amount of a contract shall be granted to
provide for more efficient administration of City government; hereby determines that more
efficient administration of City government essential to the public health, safety and welfare; and
hereby determines that the immediate passage of this ordinance is necessary to increase the
purchasing authority of the Mayor. Therefore, an emergency is hereby declared to exist and this
ordinance being necessary for the public welfare, shall be in full force and effect from and after
its passage and approval.
