AN ORDINANCE AMENDING CHAPTER 51 OF THE 1990
REVISED EDITION OF THE CODE OF FAYETTEVILLE
( CHAPTER 21 OF THE CODE OF ORDINANCES , CITY OF
FAYETTEVILLE , ARKANSAS ) CONCERNING MONTHLY
SEWER CHARGES AND RATES AND EXCESSIVE STRENGTH
SEWAGE SURCHARGES .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 , That 51 . 137 ( A ) ( 1 ) and ( 2 ) of the Code of
Fayetteville ( § 21 - 26 ( a ) of the Code of Ordinances ) is hereby
amended by amending the schedule of monthly quantity charges and
monthly service charges for sewer service to read as reflected in
Exhibit "A" attached hereto and made a part hereof .
Section 2 . That 51 . 137 ( B ) ( 2 ) ( a ) of the Code of
Fayetteville ( § 21- 26 ( b ) of the Code of Ordinances ) is hereby
amended by amending the schedule of monthly residential sewer rates
within Wedington Sewer Improvement District No . 1 of the City for
users who do not receive City water service to read as reflected in
Exhibit " B " attached hereto and made a part hereof .
Section 3 . That 51 . 138 ( A ) ( 3 ) of the Code of Fayetteville
( § 21 - 26 . 1 of the Code of Ordinances ) is hereby amended by amending
the schedule of excessive strength sewage surcharges to read as
reflected in Exhibit " C " attached hereto and made a part hereof .
Section 4 . That the Board of Directors of the City of
Fayetteville , Arkansas hereby determines that the provision of
adequate sewer service is essential to the public health , safety
and welfare of the residents of the City and that the immediate
adoption of this ordinance is necessary for the City to generate
sufficient revenues to provide adequate sewer service . Therefore ,
an emergency is hereby declared to exist and this ordinance , being
necessary for the immediate preservation of the public health ,
safety and welfare , shall be in full force and effect upon its
adoption .

Section 4. That the Board of Directors of the City of Fayetteville, Arkansas hereby determines that the provi
