AN ORDINANCE CONTINGENTLY VACATING AND C)
ABANDONING A TWENTY-FIVE FOOT UTILITY EASEMENT t
LOCATED ON PROPERTY OWNED BY GRADY KING AT t�
5745 WEDINGTON DRIVE . t
WHEREAS , the Board of Directors has the authority under A . C . A . r1
§ 14 - 54-104 to vacate public grounds or portions thereof as may not
for the time being be required for corporate purposes ; and
WHEREAS , the Board of Directors has determined that the d
following described utility easement is not required for corporate
purposes ,
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas , hereby
vacates and abandons all of its rights together with the rights of
the public generally , in and to the following described utility
easement located at 5745 Wedington Drive , Washington County ,
g Arkansas as described more fully in Exhibit "A" attached hereto and
made a part hereof ,
Section 2 , That said vacation and abandonment shall be
contingent upon the granting of a 25 foot general use utility
easement upon and across the west side of the property located at
5745 Wedington Drive , described as follows in exhibit "A" .

Section 3 , A copy of this Ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of the
County and recorded in the Deed Records of the County .

A 25 foot strip of land of equal and uniform width
running parallel and adjacent along the entire east
