AUTHORIZING THE MAYOR AND CITY CLERK TO <rn 3 m 6.�
EXECUTE AGREEMENTS FOR THE CONSTRUCTION OF o cq>
co IMPROVEMENTS ON THE K-D TOOLS FACILITY AND �
DECLARING AN EMERGENCY ,
NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That an exceptional situation is declared to
1110 exist requiring that competitive bidding be waived for the
construction of improvements on the K-D Tool Facility as more fully
set forth in AID Grant Agreement # EIF8866 in that competitive
bidding is not feasible due to the importance of immediately
S starting construction in order not to delay opening of the
a facility .

Section 2 . That the Mayor and City Clerk are hereby
authorized to execute agreements for the construction of
improvements on the K-D Tool Facility in an amount not to exceed
$ 250 , 000 for site improvements in the manner set forth in AIDC
Grant Agreement #EIF8866 .
Section 3 , The Board of Directors hereby determines that
the prompt provisions of these improvements is necessary for the
immediate operation of K-D Tools , Inc . and that such prompt
economic development is essential to the public welfare of the
people of Fayetteville . Therefore an emergency is declared to
exist and this ordinance being necessary for the public welfare
shall be in full force and effect from and after its passage and
approval .
