AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING AND AUTHORIZING THE MAYORJL��
TO ENTER INTO A CONTRACT FOR INVESTIGATIVE
SERVICES AND DECLARING AN EMERGENCY ,
WHEREAS , the Fayetteville Police Department conducted an
investigation into officer misconduct as a result of an alleged
January 14 , 1991 traffic stop involving Director Julie Nash and ;
WHEREAS , the investigation concluded that the traffic stop
\ never took place and ;
WHEREAS , the Board of Directors believes it to be in the best
interests of all concerned that an independent investigation be
held to determine whether or not the conclusions contained in the
aforementioned police investigation should be confirmed , amended
and/or changed ,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 , The Board of Directors hereby waives the
requirements of competitive bidding for obtaining investigative
services to confirm , amend , and/or correct the Fayetteville Police
Department ' s investigation of the alleged January 14 , 1991 traffic
stop involving Director Julie Nash for the reason that such
requirements are not feasible or practical in order to timely
commence and complete such investigation and due to the unique
nature of the investigation .
Section 2 , The Mayor is hereby authorized to execute an
agreement between the City of Fayetteville and Mahlon Gibson for
such investigative services at a minimum cost of $ 1 , 000 , 00 and a
maximum cost not to exceed $ 3 , 000 . 00 plus expenses and upon
mutually agreeable terms .
Section 3 , The Board of Directors hereby determines that
the immediate provision of the aforementioned investigative
services are necessary for the public safety and welfare of the
people of Fayetteville . Therefore , an emergency is hereby declared
to exist and this ordinance being necessary for the public safety
and welfare shall be in full force and effect from and after its
passage and approval .
