" 'IDTpN co AR r ZF LMCyER AN ORDINANCE AMENDING § 33 . 046 , CODE OF FAYETTEVILLE , BY SETTING THE ANNUAL FEES FOR DISCOUNT RL RE FOR NTA SOS CONT ii9b AD APPROPRIATE VOLUNTEER FIRE DEPARTMENT , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That § 33 . 046 , Code of Fayetteville entitled " Providing Fire Protection Services Outside City " is hereby amended by deleting paragraph ( A ) , ( B ) , and ( C ) and adding the following : ( A ) A mutual aid agreement or written contract , approved by the City Board of Directors , with another municipal corporation or with a duly and legally organized fire department which operates in he Washington County . g U ( B ) A written contract executed with a group of residents or property owners of a specifically defined area located not more than two miles beyond J the city ' s corporate limits ; which contract shall aj be known as a "Association " contract and which shall be defined as a contract covering not less than three contiguous properties , and which LL contract shall contain the following provisions : 1 . Each property owner or resident desiring to participate in such a contract shall pay to the city an annual fire protection fee of $ 177 per property covered within the "Association" per twelve ( 12 ) month period . ( C ) A written contract executed with an individual resident or property owner of a specific property located not more than two miles beyond the city ' s corporate limits ; which contract shall be known as an " Individual " contract and shall be defined as a contract covering one or two contiguous properties and which contract shall contain the following provisions : 1 . Each property owner or resident desiring to participate in such a contract shall pay to the city an annual fire protection fee of $ 354 per property covered per twelve ( 12 ) month period . IIRR 140,7PAGE032 ( D ) Annual fees for fire protection contracts for services outside the City of Fayetteville shall be as contained herein for the years 1991 - 1992 and 1992 - 1993 . ( E ) Each contracting party shall receive an annual discount of forty dollars ( $ 40 . 00 ) per twelve ( 12 ) period upon showing proof to the Fayetteville Fire Chief or his authorized representative of a fire protection contract with a rural fire department servicing the same property and covering the same twelve ( 12 ) month period as the city contract . ( F ) The Fayetteville Fire Department shall have the right to refuse to respond to any fire located outside the city ' s corporate limits if , in the judgment of the fire chief or his authorized representative , fire protection within the city would be impaired by such a response . ( G ) No contract shall be executed without the prior determination by the fire chief or his authorized representative that the property covered by the contract can be identified and protected by the fire department .
